Matthew Hamilton is reporting at Capitol Confidential a state appeals court has ruled Zephyr Teachout can remain on the Democratic primary ballot. Second Judicial District appeals court judges in Brooklyn Wed., Aug. 20, upheld a decision by a lower court to allow gubernatorial hopeful Teachout to remain on the ballot. despite a challenge from incumbent Andrew M. Cuomo. Cuomo argued his challenger did not meet the minimum five-year residency requirement to run for governor. Teachout and Randy Credico will appear on the ballot along side Cuomo in the Democratic primary next month. A Quinnipiac poll Wednesday showed 88 percent of New York voters are not familiar with Teachout. According to Hamilton, capitol watchers have maintained that while the Fordham law professor might be able to take enough votes to embarrass the governor she is not likely to be a serious threat. Ariel Zangla is reporting in the Daily Freeman U.S. Rep. Chris Gibson said he is doing his best to bring people together and find ways to make a difference through his legislative work and by addressing constituent needs. The Kinderhook Republican was interviewed at the Daily Freeman's office in Poughkeepsie, Tues., Aug. 19. Gibson is seeking his third two-year term serving the 19th Congressional District. His challenger is Democrat Sean Eldridge of Shokan. During the interview, the retired U.S. Army colonel spoke about a variety of issues including tax reform, the New York City watershed, immigration reform, Planned Parenthood and the federal Affordable Care Act. He said the campaign finance systems needs reform and expressed his belief in term limits. Gibson said he is ranked the second-most independent Republican in the House, voting with his party 74 to 75 percent of the time. On the issue of hydraulic fracturing, Gibson said he feels the federal government should impose baseline regulations on the practice to make sure the companies involved comply with the Safe Water Drinking Act and disclose the chemicals they use. He also supports New York state taking its time to research the issue and allowing communities to decide for themselves whether they want to allow the process. Jim Planck is reporting in The Daily Mail the former director of the Washington Irving Senior Center pleaded guilty Tues., Aug. 19, to third degree grand larceny, a class D felony. Anne Marie Moran was charged in March with transferring more than $70,000 from the personal banking account of an elderly senior center patron into her own account, over a period of more than a year. Under the plea agreement Moran waived indictment and will serve six months in the Greene County Jail, followed by five years probation and full restitution. Moran was a town of Catskill employee. The town owns the senior center. Moran resigned her position in April. She will be formally sentenced Oct. 7 and remains free on bail until that time. Read the full story in The Daily Mail.

Jim Planck is reporting in The Daily Mail Central Hudson Gas & Electric said Tues., Aug. 19, the power outages that occurred throughout Greene and southern Albany counties Monday were the result of a downed phase wire on Paul Saxe Road in Catskill. The outage interrupted service for more than 13,000 customers for nearly four hours. A Central Hudson spokeswoman said the specific cause of the problem remains under investigation. In Greene Co., power was lost in Cairo, Durham, East Durham, Greenville, Tannersville, Haines Falls, New Baltimore, Lawrenceville, Round Top and briefly in Coxsackie.

Attorney General Eric Schneiderman announced on Aug. 19, 2014 that 46 thrift shops across New York -- including two locally -- have been sent cease and desist letters ordering them to stop selling children’s clothing with drawstrings. The letters were sent after a survey of 51 stores by the Attorney General’s 13 Regional Offices found that despite state and federal prohibitions against the sale of children’s drawstring clothing, many thrift shops continue to items for sale. His list of 46 includes the Goodwill Industries store in Wappingers Falls in Dutchess County, and the Salvation Army in New Paltz in Ulster County. Under New York law, it is illegal to sell any item of children’s clothing, up to and including size 12, with a drawstring at the neck.

Vince Pecoraro is reporting in the Chatham Courier state Assembly member Steve McLaughlin last week accused Phil Malone, his opponent in the November general election, of failing to file required ethics forms. In a statement released by his office McLaughlin called Malone “another member of the corruption club who is trying to get elected on a platform of incompetence and deceit.” The ethics forms are a requirement for all political candidates. Malone admitted he was late to file the form, but said he has nothing to hide. He also said the forms were submitted before McLaughlin raised the issue. He accused his opponent of grasping at straws to get headlines. Republican McLaughlin and Democrat Malone will face off in November for the 107th Assembly District seat. The district includes parts of Columbia, Rensselaer and Washington counties. Malone will be a guest on WGXC's @Issue, 10 a.m., Wednesday (Aug. 20). Read the full story in the Chatham Courier.

The Daily Freeman is reporting the investigation into the source of the oil spill at the town boat launch in Germantown, Sun., Aug. 17, is ongoing, according to state environmental officials. The state Department of Environmental Conservation said between 50 and 100 gallons of No. 6 fuel oil spilled from a 50-foot black pipe. The DEC reported winds pushed the spilled oil to the east shore and it was contained in a small area. Anyone with information about this spill are asked to contact the DEC at (800) 847-7332.

The Poughkeepsie Journal is reporting a scam is making the rounds among customers of New York State Electric & Gas Corp. Callers say they represent the utility company and claim that service will be cut off unless a GreenDot MoneyPak Card is purchased. A company spokesman said NYSEG (NIGH-segg) would never ask a customer to purchase a debit card to make a payment. The company does not call a customer for payment if an account is in good standing, either. If customers believe they have been scammed out of money, NYSEG advises they immediately notify local police, as well as the Federal Trade Commission at www [dot] ftc [dot] gov.

Some of the stories that made the news Fri., Aug. 15 through Mon., Aug. 18:

Adam Clayton is reporting in the Register Star numerous Columbia County agencies responded to the report of an oil slick on the Hudson River’s surface near the Germantown Boat Launch Sun., Aug. 17. The call came in to County 911 a little before 5 p.m. The spill was believed to have been caused by a transfer line that fell from a tanker ship traveling southbound on the Hudson River. The boat launch is located at the end of Anchorage Road in Germantown. The Poughkeepsie Journal is reporting the impact of the spill was limited to 100 yards along the shore. The launch was cordoned off and remained closed as of Sunday evening.

The Daily Freeman reported the state Department of Labor’s efforts to inspect amusement park rides are thorough, but more work is needed to ensure safety and inspections at small, temporary festivals, according to an audit by the New York State Comptroller's Office. There were 51 state, county and regional fairs scheduled statewide in 2013. Auditors found only the Greene County Youth Fair in Cairo was not visited by a labor department inspector. The Department of Labor told the auditors that a listing of rides the operator planned to bring to the Greene County Youth Fair had been inspected at previous fairs and all had valid permits. The Department of Labor’s Division of Safety and Health oversees amusement park ride safety outside of New York City through its Industry Inspection Unit. All rides are to be inspected at least once a year as part of an annual permit process.

Melanie Lekocevic reported in The Daily Mail the Athens Village Board adopted a public nuisance law last week. While there was substantial resistance to the law from community residents during the public hearing last month, the law was unanimously approved. The law pertains to buildings in the village that do not comply with local law, whether because criminal activity takes place there or because the property is abandoned or in very poor condition. The law establishes an administrative panel, which will be appointed by the Village Board to oversee specific cases. The panel will work with property owners to address the problems, but will not be able to force a building to be torn down or impose fines on property owners. Critics say the law places too much power into the hands of village officials. There was also concern that power would be misused.

Barbara Reina reported in the Register Star the Kinderhook Memorial Library is circulating petitions in Stuyvesant and Kinderhook requesting a referendum be included on the November ballot seeking voter approval to increase each town’s annual contribution in support of the library. The increased contributions would further subsidize the library's estimated $350,000 annual budget, in addition to upgrades to the library website. Valatie Free Library is not included in the petitions being circulated. The library hopes to have the needed signatures by Aug. 31.

New York State got a B grade for accessibility of information about executive orders from the Sunlight Foundation, in its latest rankings of the states. Governors issue executive orders for weather disasters, educational mandates, drilling for gas on state land, and other issues, and they often come with less accountability then laws passed through legislative efforts. "Executive orders in 38 states are not subject to any form of administrative procedure act, a law that governs the process by which regulations are proposed and enacted. Only six states subject executive orders to legislative review, and a further six have legislative review requirements for a subset of executive orders, usually those concerning agency creation," according to the Sunlight Foundation. New York had 163 executive orders since 2009, with data available as a PDF with optical character recognition, archived for at least a decade. Brian Nearing in the Albany Times-Union reports that while unemployment rates in Greene and Columbia county stayed flat in July 2014, the jobless rate fell in five Capitol region counties. Albany (5.1 percent), Rensseler (5.4), Saratoga (4.5), Schenectady (5.4) and Schoharie (6.5) all had drops in unemployment in the last month, while Greene and Columbia counties remained at 6.1 and 4.8 percent, respectively. Dutchess County had a 5.3 percent level, and Ulster County came in at 6.1 percent unemployed. Columbia County had the fifth lowest level in New York. Statewide, the unemployment rate was also unchanged at 6.6 percent in July, remaining at its lowest level since November 2008. The private sector has added jobs in 38 of the past 43 months, according to the state Labor Department. Read the full story in the Albany Times-Union.

Parry Teasdale in The Columbia Paper writes an editorial about the weekly's coming website updates. "The idea is to expand online before Google, Facebook and Amazon merge into a single company that feeds us, walks our virtual dogs and fills out our election ballots," Teasdale writes, without any details of what those changes may entail. Currently, "over the last 30 days Google tells us that our website had 6,466 'unique visitors' and 25,367 pageviews, not including our Facebook traffic," he writes, noting that may be a quarter of Columbia County households. The unit was hooked up at the Catskill Community Center this week, where Peter Krug and Jill Sutton hosted the "WGXC Afternoon Show" Aug. 12. On Sept. 1, the station will wheel it over to its new home at the Catskill Library. There, it will host several shows on the community radio station, but also, sometimes, it will be wheeled away for remote broadcasts.

The Daily Freeman reports that WMHT-TV will air the broadcast premiere of the independent film, “To Be Forever Wild,” made in the Hudson Valley, at 7:30 p.m. on August 20. The film chronicles people the filmmakers met, the places they visited and the history discovered in the Catskill Mountains, with filmmakers staying in a small red cabin once used by Jack London and now loaned to artists by the Catskill Center. Jim Planck is reporting in The Daily Mail the Catskill Waterfront Resilience Task Force is seeking feedback on its plans to reduce flood risk in and around the village of Catskill. The task force will present its recommendations for immediate action to reduce risks from floods, plus a long-term resiliency plan to the public next week. Village President Vincent Seeley said the plan includes zoning recommendations for the waterfront, bank stabilization advice and the creation of a handbook containing information on steps to take in the event of a flood. Seeley urged all interested parties to attend, stressing the importance of getting feedback from the community. The task force report will eventually be made available online, and at the Catskill Library, as well. The task force presentation is scheduled to take place 7 p.m., Tues., Aug. 19 at the Washington Irving Senior Center located on Academy St. in Catskill. Read the full story in The Daily Mail.

The Daily Freeman is reporting the legislation to name a portion of state Route 23 for retired clerk of the Greene County Legislature Donald Olson has been signed into law by Gov. Andrew M. Cuomo. The roadway will be called the "Honorable Donald Olson Memorial Highway." The legislation was introduced state Sen. Cecilia Tkaczyk (KAT-chik). Olson died in a car accident in Windham in May 2013. He was a longtime Prattsville town justice and a volunteer firefighter with the Prattsville Hose Company for more than 25 years. The new law takes effect immediately.
