The Register Star is reporting a State of Emergency has been declared for a two-mile radius from the Route 9/9H roundabout in Kinderhook following a fuel spill. A tractor-trailer carrying 8,000 gallons of fuel overturned, spilling the gas. No injuries have been reported. All businesses in the area have been closed. The area has been shut down to traffic and is expected to remain closed for an extended period of time. Students in the Ichabod Crane school district will be delayed getting home and all afterschool programs have been canceled. The statement at the district's Web site:

Please note that we are expecting delays in your child's transportation home this afternoon. This is due to a traffic accident resulting in a home heating oil spill in the roundabout near Hannaford Plaza. All students are safe and there is no imminent danger involving the situation. The Superintendent of Schools is at the scene with the HAZMAT Team getting updates as they are available. All afterschool activities are cancelled including the Open House at the Middle School and OK Kids. Although the Town has declared a State of Emergency, the situation is under control. We ask that you please not come to pick up your children any earlier than you would on a normal school day. As we get more information we will update when needed. We will also let you know when the Middle School Open House is rescheduled.

The Catskill Village Board made history Wed., Sept. 11, with passage of the "Brine Prohibition Act." The local law will prohibit the use of production brine, or flowback fluids produced from the hydro-fracking process within the village. It is the first law of its kind in Greene and Columbia counties. Approximately 20 people, including members of the Greene Renewable Energy and Environmental Network, or GREEN, witnessed the board's action at the Washington Irving Senior Center. Board member and Greene County Legislator Joe Kozloski made the motion; board member Jim Chewens seconded, and the full board voted unanimously in favor of the new law. [PLAY passage of the Brine Prohibition Act (2:21).] Brine is generated as a result of drilling for gas or oil, and contains a variety of hazardous chemicals in addition to substances picked up from deep within the earth, such as heavy metals and radioactive materials. The new law prohibits "the introduction of natural gas and/or oil production byproducts into any wastewater treatment facility within, or operated by the Village of Catskill. Also prohibited is the application of natural gas and/or oil production byproducts on any Village-owned road or Village-owned property, whether as a de-icing substance, dust suppressant, or for any other purpose." Nathan Mayberg is reporting in the Register Star the Columbia County Board of Supervisors voted Wed., Sept. 11, to approve the issuance of $12.5 million in bonds to pay for upgrades to emergency services equipment, the Pine Haven Nursing and Rehabilitation Facility construction project design, bridge repair and highway department equipment. The bond resolution was $1 million less than a previous resolution approved by the board’s Finance Committee. With the addition of the new bonds, the county’s long-term debt obligations would rise to nearly $48 million, according to Controller Ron Caponera. Gallatin Supervisor Thomas Garrick was the lone dissenting vote Wednesday, expressing concern about the county's long-term debt. Read the full story in the Register Star.

John Mason is reporting in the Register Star the new owners of the former Ackerman's Appliance store, located at the corner of Warren and Eighth streets in Hudson, have announced plans to open a year-round fish, meat and produce market. The Hudson Anchor Market and Supply will be housed in the first floor and basement of 752 Warren Street. It is projected to open in June 2014. The owners' intention is to provide a market near the city center catering to a pedestrian customer base. Melanie Lekocevic is reporting in The Daily Mail construction of a new highway garage in Coxsackie may soon move into its next phase with the hiring of a construction manager. The construction manager will prepare the project bids and oversee that process. The project has been in the works for years, and until last year was put on the back burner because of the $3 million price tag. After the Greene County Legislature threatened to demand the return of the property town officials renewed their efforts to move the project forward, but with a reduced budget of $1.5 million. The Register Star is reporting the Columbia Land Conservancy’s Down To Earth workshop series featuring farmland leasing workshops is set to begin Sept. 19. The workshop is intended to help farmers and landowners interested in leasing farmland learn how to establish successful, long-term rental relationships. The program partner is the Dutchess Land Conservancy. The Farmland Leasing 101 workshop will be held Sept. 19 at the Farm Credit East building, located on Route 9H in Claverack. Parents of Cairo-Durham Elementary students were informed Mon., Sept. 10, effective immediately, the water at the Durham building is off limits for at least two days as the result of low chlorine levels. In a letter home (provided to WGXC by a district parent) building principal Scott Richards and Kevin Lawton, Cairo-Durham Director of Buildings and Grounds, characterized the problem as "a situation regarding [the] drinking water." Richards and Lawton explained the water was tested Monday morning "as it always is," and the test sample returned a normal chlorine level. However, the water was sampled again in the afternoon and that test revealed a low chlorine level. After the results of that test were know, "the drinking fountains were made off limits to students and staff. Fresh bottled water was brought in immediately," according to Richards and Lawton. Health Department policy dictates water in the building cannot be used for consumption until after two days of satisfactory water samples have been returned. The general condition of the 75-year-old building recently come under scrutiny by parents and community members expressing concerns about its general upkeep and safety. The building currently houses more than 250 students. No information on the boil-water alert is available at the Cairo-Durham Central School District's Web site.

Kyle Adams is reporting in The Daily Mail the Public Works Committee of the Greene County Legislature Mon., Sept. 9, approved the second part of a proposed $400,000 improvement plan for the Greene County Mental Health Building in Cairo. The committee approved setting aside $300,000 to replace a steam boiler, repair the roof and gutters, add attic insulation, install de-humidifiers and conduct asbestos abatement. The Public Safety Committee previously approved spending $100,000 to install metal detectors, upgrade the telephone system, redesign the front door and entry and add additional part-time security personnel. The 19th centry building houses the offices of Greene County Mental Health, the Greene County Soil & Water Conservation District, and the Greene County Child Advocacy Center. The money for the improvements will come from the County Initiative Program Fund, which currently holds about $1 million. NOTE: Public Safety Committee Chairman William Lawrence is a WGXC programmer. The decision was announced by Hudson Superintendent Maria Suttmeier. Suttmeier said the facilities for the program at 364 Warren Street are not yet ready for use. However, the major factor affecting the start of the program is a ruling by lawyers at the New York State Education Department that both the Hudson and Catskill districts would need to conduct local referendums allowing voters to approve the districts' participation in the program. Lawyers for the Hudson district believe the district does have the right to commence the program without voter approval. According to Suttmeier, Catskill faces a slightly different set of questions regarding the need for a referendum. Read the full story in the Columbia Paper.

5:30 a.m.: Radio News: NSA Surveilling Smartphones From "Free Speech Radio News": "In the latest revelations about US government spying, the NSA has the capacity to hack into smartphones, accessing vast amounts of data including call logs, contact lists, text messages and geolocation information. That’s according to Laura Poitras, who co-authored a report today in Der Spiegel based on NSA documents leaked by Edward Snowden. The NSA has developed specific teams to target certain companies or operating systems, such as Apple’s iPhone, according to the report. The documents, some of which Der Spiegel published, show examples of private photos and text messages that the US government accessed, such as an email sent by a Mexican government agency through a Blackberry encryption technology but intercepted by the NSA. For more, we’re joined by Barry Steinhardt, founder of Friends of Privacy USA. In a related update, Facebook, Google and Yahoo filed separate court motions today to allow them to reveal more details about the government’s surveillance program. Tues., Sept. 10, is Primary Day in New York. In Greene County, Independence Party voters in Athens and Windham will go to the polls. The Daily Freeman reported in Athens there is an opportunity to ballot write-in race for town supervisor, and Republican voters will choose four members of the Greene County GOP Committee. In Windham, Indepenendence Party opportunity to ballot races include town supervisor and two seats on the Town Board. John Mason reported in the Register Star in Columbia County the only countywide primary race is in the Republican contest for sheriff between Deputy Sheriff David Bartlett and Greenport Fire Chief and former State Police Investigator Gary Mazzacano. At the town level 11 primaries will be held in Copake, Gallatin, Livingston, Stockport and Stuyvesant. Stuyvesant has four primaries; all write-in contests, for town supervisor, town clerk/tax collector, town board and town justice. There are no primaries in Hudson, except for the sheriff's race. Several Hudson Independence Party races were eliminated because of errors on the nominating petitions. Polls are open from noon to 9 p.m.

Bryan Rowzee reported in the Register Star the Town of Coeymans Planning Board last week approved TCI-NY's site plan for a new transformer recycling facility along Riverview Drive. It has been more than one year since a major fire destroyed the company's facility in Ghent. TCI began seeking approval at the end of May and has performed limited transportation operations at the Port of Coeymans since that time. During the public hearing held prior to the vote, the board heard from David Crawford, president of Hudson-based Crawford and Associates and TCI-NY President Brian Hemlock in support of the site plan. Brian Hubert reported in The Daily Mail a contingent of angry parents attended the Cairo-Durham Board of Education meeting Thurs., Sept. 5, and expressed their great displeasure over lengthy bus delays on the first day of school. In some cases, delays stretched to two hours. Thursday marked the first day of the district's new elementary grade-level realignment plan. Students in grades kindergarten through second are now housed in the former Durham elementary building; grades three through five are located in the former Cairo elementary building. During the board meeting Superintendent Mary Fassett attempted several times to explain the delays were caused by first-day mishaps that would disappear as children and staffers became more accustomed to new routines. Parents complained that when they tried to reach the district office or the transportation office about the delays they reached the voicemail system and the calls were never returned. Fassett apologized, promising robocalls to parents in the future when buses are running late. Board President Susan Kusminsky called the first day issues unacceptable, and promised better communication in the future. Read the full story in The Daily Mail.

[caption width="256" align="alignright"] Windham Mountain's electric vehicle charging station.[/caption]On Fri., Sept. 6, Governor Andrew Cuomo announced a new $2 million program to help fund research and demonstration projects related to electric vehicles. Locally, it is tough to find an electric charging station. Carstations.com only lists Windham Mountain's station in Greene and Columbia counties. Windham added the station in January. The Bard College Alumni Center in Red Hook, and the currently-closed Zen Dog Cafe in Rhinebeck, in Dutchess County, are the next closest locations, with two also in Albany. Cuomo says he has a, "goal of establishing a statewide network of up to 3,000 EV charging stations over the next five years," but with only 600 right now, that's a long road ahead, with his $2 million Electric Vehicle-Enabling Technology Demonstration Program, just a jump-start.

Bill Lambdin at WNYT reports that some of the helicopters one sees in the skies in September locally, are searching for illegal marijuana fields. Several media crews joined Schoharie County Sheriff Tony Desmond for his helicopter trip Wed., Sept. 4, to find 21 marijuana plants in Esperance, and spot another 50 plants that the sheriff would get to another day. The Marijuana Policy Project reports that the New York Assembly passed two bills in 2013. One would legalize medical marijuana, and the other bill would fix the "public view" loophole in New York's decriminalization law. The New York Senate adjourned without taking up either bill.

Lisa Foderaro in The New York Times reports reports environmental activists and the Olana Partnership oppose a plan to erect a 190-foot communications tower on Blue Hill in Livingston, about two miles away from Frederic Church's 250-acre property. The Olana property is now a state historic site noted for its viewshed (and, full disclosure, Olana is partnering on a Sept. 22 fundraising event with WGXC). Opposition to the tower, which was recently approved by Livingston’s planning board, is based on viewshed obstruction. Activists are suing the town, as well as the farm family who applied to build the lattice tower, to overturn the approval on the grounds that the environmental impact on the viewshed was not adequately considered. Livingston officials, however, say they did abide by the State Environmental Quality Review Act, considering feedback on the visual impact of the tower, which will measure 13 feet across at the tree line. According to the application for the new tower on Blue Hill, some two dozen small antennae and satellite dishes would occupy the structure. There are already two smaller communications towers on Blue Hill. Local Firefighters and emergency workers strongly supported the application, citing the need for better signals for police and fire department communication devices. Scenic Hudson’s land use advocacy director, Jeffrey Anzevino, said the group and Olana recognized the need for better emergency services. “They are important for everybody,” said Anzevino, whose group has spent years and millions of dollars conserving about 1,500 acres of land within view of Olana. “But we don’t think that public safety and views are mutually exclusive.
