The Athens noise war continued over the weekend. Dionysos Restaurant reported on its Facebook page Fri., Sept. 21, as of midnight its liquor license was suspended, due to the "excessive noise complaints" made to the New York State Liquor Authority:

The mayor and village board members are on our side and helping with our appeal. They are being very supportive. We are most definitely appealing the decision and wil stay open through this ordeal. We are not sure how lengthy or costly this will become...

The issue heated up this summer when S. Water Street neighbor Sheila Brady, owner of Brady's Docks, local musicians and Dionysos sparred over how late, and how loud music performed in the eatery’s outdoor pavilion could be performed. Mayor Andrea Smallwood said there are no plans to ban outdoor music. “The issue is timing and volume, but not to ban it,” she said.

Tom Casey reported in the Register Star Republican challenger David Byrne has taken the lead over Assembly member Didi Barrett in the Independence Party primary for the 106th Assembly District. On election night, the race was deemed too close to call. With votes tallied in Columbia and Dutchess counties, Byrne is up, 192 to 175. Barring delays, results could be certified as early as the middle of this week. Read the full story in the Register Star.

According to a press release published in the Register Star, delegates to the Democratic 3rd Judicial District Convention Fri., Sept. 21, nominated Kinderhook resident Richard Mott as their candidate for New York State Supreme Court Justice. The 3rd Judicial District includes Albany, Columbia, Greene, Rensselaer, Schoharie, Sullivan and Ulster counties. Mott is a native of Ulster Co., and has resided in Columbia Co. since 1976. He is a trial attorney in private practice. Mott served in the county Public Defender's Office from 1982 to 1987. He also served as Kinderhook town attorney from 1984 to 1986. The convention also nominated Stephan Schick for the second available seat on the court. Schick is a criminal defense attorney from Sullivan Co. Read the full press release in the Register Star.

David Seth Michaels reported at Daily Kos on the anniversary of the weekly Vigil for Peace, Justice and Reverence for Life held by Martin Baumgold every Saturday afternoon since Sept. 22, 2001 in Seventh Street Park in Hudson. For 11 years, Baumgold has showed up virtually every Saturday at 2 p.m. to stand up for peace until 4 p.m. -- nearly 500 afternoons in all kinds of weather. WGXC's Chris Bishop recorded parts of the Ghent Town meeting Thu., Sept. 20 where folks discussed the Ghent Industrial Fire of Aug. 2, 2012. The meeting was moved at the last minute, to the VFW Hall to accomodate a large audience. First, West Ghent Fire Chief Jim Cesternino explains how even knowing there was sodium in the building, the firemen did a "surround and drown" with water on the fire, hoping it was just a "contents fire."

"Secondly, after the TCI section of the meeting was over and all but a few attendees went home or to Kozels, Ted Gutterman discussed who from the Town of Ghent was actually at the August 16 meeting at the West Ghent Firehouse: 'The Town of Ghent was well represented at that meeting. Not only was I there but the Town Engineer was there. The Chairman of the Planning Board was there. The Planning Board had a quorum there, they could have had a meeting. There were several members of the Planning Board there. There were at least two members of the Zoning Board there including the Zoning Board Chairman. The Building Inspector was there. Our Zoning Enforcement Officer was there.... I think the Town is doing a good job of keeping up to date, we're getting reports on a daily basis on what is going on with the site.'"

A Peace Pole from the Hudson Rotary Club was dedicated on the green in Hudson's Public Square (park on Warren and Seventh St.), Thu., Sept. 20. The pole was a donation from the Hudson Rotary Club, and now designates Hudson as a City of Peace. WGXC's Jess Puglisi was there to record comments from Kieran Riley, Mike Howard (President of the Rotary Club and also a local attorney), Jeevan Goff (of Lotus Energy, and also a Rotary Club member), and Kristianna Abel. Hudson Mayor William Hallenbeck and the Rotary's Howard dedicated the pole, and their comments take up the last five minutes of audio. Friday, September 21, is International Day of Peace. There was a crowd of roughly 20 people present for the dedication, including some local peace activists, rotary members, and Rabbi David Fried. A group of local activists have been holding peace protests in the park on Saturdays the last 11 years since right after the Sept. 11, 2001 attack on the World Trade Center. PLAY NEWS REPORT (8:00)

Pheasants are being released throughout our area by the Department of Environmental Conservation, as youth pheasant hunting season begins next weekend, Sept. 29-30. Some of the hunters may have raised the birds, which are culled from the Day-old Pheasant Chick Program. From the DEC:

"This program was developed in the early 1900s to provide day-old pheasant chicks to cooperating 4-H groups and sportsmen and sportswomen. The chicks are distributed to program participants in May and June, and cooperators incur all costs associated with rearing the birds, including feed, water, utilities and facility construction. The birds are raised to adulthood and released on lands open to public hunting before the season opens. This year, over 42,000 pheasant chicks were distributed statewide as part of this program. Anyone interested in raising and releasing pheasants to expand next year's hunting opportunities should contact DEC's Reynolds Game Farm at (607) 273-2768."

Jamie L. Carlson-Garland is reporting in The Daily Mail the Greenville Town Board is the most recent Greene County municipality to be confronted by concerns over mass gatherings or noise. An outdoor concert held Sept. 8 at the Greenville Drive-In drew complaints from residents, saying the event was extremely loud and profane. Drive-in owner Jim Gatehouse appeared at a recent meeting of the Town Board and apologized. “This will never happen again. The movies are not making any money and that’s why I did it,” he said. Gatehouse indicated he is actively looking for alternative ways to raise revenue. The drive-in reopened this summer after being shuttered for more than a decade. Town officials indicated they will take a look into laws currently in place in other communities governing noise and large events. Jim Planck reports in The Daily Mail Town of Catskill Justice William Wootton received the Town of Catskill Republican Party’s nod for the seat on the November ballot. Catskill GOP held its caucus Tues., Sept. 18, at town hall. Wootton received the endorsement unopposed, said Town Republican Chairman Aaron Hodor. He said Wootton has a solid base of support in Catskill. Wootton is expected to run unopposed in November. Hodor reported a healthy turnout for the caucus, despite the extreme weather conditions that night. Read the full story in The Daily Mail.

Nathan Mayberg reports in the Register Star the Columbia County Board of Supervisors is reconsidering a homeless housing project in light of a reported drop in the county's homeless population. In early September, the county reported 27 homeless individuals received housing assistance, living in 17 local motel rooms, a decrease of 57 percent since March, and a 72 percent drop since last year. Columbia County Department of Social Services Commissioner Paul Mossman reported to the Board of Supervisors Human Services Committee Wed., Sept. 19, the numbers have "...never been this low before." In light of that information, Mossman told the committee, he was considering downsizing the scope of the proposed Galvan Quarters project currently under consideration by lawmakers. That plan calls for a facility to be located on the northwest corner of State and Seventh streets (one block from the WGXC Hudson studio), comprised of 19 SRO units for use as emergency housing, and 18 studio units for use as transitional housing. The shelter could cost the county up to $648,000 a year. The state would reimburse the county for 29 percent of that expense. Mossman cautioned the supervisors Wed., saying the homeless population could increase this winter, as it has in the past. "There is no guarantee," he said, the lower levels will continue. Thomas Kaplan is reporting in The New York Times as Gov. Andrew M. Cuomo seeks legislative and public support for an expansion of the number of casinos in New York, the gambling industry is pouring millions of dollars into lobbying state lawmakers and donating to their campaign funds. Indian tribes, racetrack casinos and other gambling interests have spent nearly $50 million on lobbying and campaign contributions in the state since 2005, according to a new analysis by government-reform group, Common Cause New York. The surge in spending comes just as the Cuomo administration and the Legislature are discussing how and where to allow new casinos. And there seems to be no end in sight, Kaplan reports, as the industry is on pace to spend more this year than ever before, according to the report, set to be released Wed., Sept. 19. Gambling interests spent nearly $4 million on lobbying, and more than $700,000 on campaign contributions in the first half of 2012, records show. Read the full story in The New York Times.

Kyle Adams reports in The Daily Mail on the impact of high winds and torrential rain in Greene County, Tues., Sept. 28. Tornado watches were issued throughout southern and eastern New York late in the day, including Greene County, which was also issued a flash flood warning. Central Hudson Central Hudson Gas & Electric Corp. reported a peak of 340 outages in Greene County as a result of trees and branches falling on power lines, Some 100 customers in the county remain without power, but Central Hudson expects service in the county to be fully restored sometime Wed., Sept. 19. Kaaterskill Creek rose to the top of areas stabilized after Tropical Storm Irene and experienced some erosion of its banks, according to Catskill Town Councilman Kevin Lennon. Billy Shannon writes in the Register Star there were multiple reports of wires down either on trees or roadways to the Columbia County 911 Office and power outages spread sporadically countywide by early evening, Tuesday. Reports of wires down and/or burning were made in Chatham and Clermont; in Taghkanic firefighters were called to the scene when a tree crashed onto power lines and snapped a utility pole. Patricia Doxsey reports in the Daily Freeman nearly 14,000 customers remain without power this morning in Dutchess and Ulster counties, as a result of the storm. Trees were reported down throughout the area. Route 47 in Shandaken was closed beginning 6 p.m., Tuesday, for about one-half mile between Deer Lane and McKinley Hollow when the Esopus Creek overflowed its banks. Ian Lee, a meteorologist with the National Weather Service in Albany said as much as four inches or more fell across the Hudson Valley and into the Catskills by early evening, Tuesday. Kyle Adams reports in The Daily Mail the Thomas Cole National Historic Site has unveiled plans to restore one of the painter’s original studios. The “New Studio,” as it is called, was constructed according to Cole’s own designs in 1846, but torn down in 1973 after falling into disrepair. When completed, the New Studio will provide a year-round, state-of-the-art gallery for exhibitions, lectures and special events. “Every time we do something new, it expands our visitorship,” said Vice Chairman Hudson Talbott at a Village of Catskill Planning Board meeting, Mon., Sept. 17. The site currently draws 10,000 visitors per year, he said. The planning board enthusiastically supported the plans, but concerns were raised over increased vehicle traffic on Hudson Ave. Village of Catskill President Vincent Seeley said the village would be more than willing to make whatever road improvements are necessary. Billy Shannon writes in the Register Star 43rd District state Senate Democratic challenger Robin Andrews has challenged her opponents to a series of debates, leading up to the general election in November. Potential Republican candidates incumbent Roy McDonald and Karthy Marchione are still awaiting the results of their primary face-off, last Thursday. Absentee ballots in Columbia County will be opened Mon., Sept. 24. Regardless of those results, both candidates already have a spot on the ballot -- McDonald on the Independence line, Marchione on the Conservative. “Clearly it’s a three-way race no matter what since we all have a line,” Andrews told the paper, Tuesday. Andrews challenged McDonald and Marchione to a series of debates, the dates and locations to be determined. The redrawn 43rd Senate District includes Columbia County, most of Rensselaer County and parts of Saratoga and Washington counties. Read the full story in the Register Star.

Rick Karlin speculates at Capitol Confidential that if Marchione ends up winning the GOP line, Andrews could find herself the recipient of a half-million dollars in last-minute campaign contributions from deep-pocketed supporters of marriage equality intent on keeping Marchione out of the Senate. Marchione, the Saratoga County Clerk, challenged McDonald largely on his vote last year in support of marriage equality. “It would obviously help,” Andrews said when told that she could get a financial windfall. She said she currently has about $40,000 on hand, a fraction of what her GOP primary contestants spent. Unlike Marchione and McDonald, Andrews has run no TV ads. [7:10 p.m.] UPDATE: The National Weather Service in Albany has now issued a severe thunderstorm warning for the Capital Region, including eastern Greene County and all of Columbia County until 8 p.m. A tornado watch remains in effect until 11 p.m. for northern Connecticut, western Massachusetts and eastern New York.

The National Weather Service in Albany has issued a flash flood warning for Greene County and western Ulster County, until 10:30 p.m., Tuesday. A flash flood warning means that flooding is imminent or occurring.

As of 4:23 p.m., radar indicated flash flooding was developing from heavy rainfall throughout the warning area, including (but not limited to) Windham and Prattsville. Rapid runoff from heavy rainfall will lead to flash flooding.

According to the NWS, radar estimates and actual gage readings indicate two to four inches of rain has fallen across portions of Greene and mainly western Ulster County. Additional rainfall of one to three inches is possible tonight.

The NWS advises those in the warning area to move to higher ground immediately. Residents living along streams and creeks should take immediate precautions to protect life and property. Do not attempt to cross swiftly flowing water or waters of unknown depth by foot or by vehicle, NWS warns.

A hazardous weather advisory, including tornado and wind warnings, is also in effect for all of Greene and western Columbia counties through late tonight into tomorrow morning. Wind gusts of 46 to 57 mph are possible. Downed trees and limbs and power lines can be anticipated, according to NWS.

Central Hudson Gas & Electric Corp. is reporting power outages caused by steady wind gusts throughout its service territory, which includes Columbia and Greene counties. As of 7 p.m., 266 customers were without power in Greene County; 76 households were without power in southern Columbia County. National Grid is reporting outages in Taghkanic, Stottville and Valatie, in Columbia County. The company reported 2,200 customers in the Valatie area are current without power.

Billy Shannon reported in the Register Star the too-close-to-call 43rd District Republican Senate primary race between incumbent Sen. Roy McDonald and Saratoga County Clerk Kathy Marchione will be decided by some 1,500 absentee ballots. The race is a virtual dead heat with no projected clear winner. Late Thursday, the results showed Marchione ahead by 138 votes, districtwide. In Columbia County, McDonald led by 14 votes over Marchione. The boards of election in Rensselaer, Saratoga and Washington counties will begin the absentee count, Thurs., Sept. 20; Columbia County will begin its count, Fri., Sept. 21. Regardless of who wins the Republican line, both candidates will appear on the ballot in the general election -- McDonald for the Independence Party and Marchionne on the Conservative line. Kyle Adams reported in The Daily Mail the primary is not quite over in Durham. Patricia Handel won the Republican nomination against opponent Les Armstrong in the race for Greene County Legislature by a vote of 148 to 92. However, Armstrong bested Handel by one vote in the contest for the Independence Party line, According to Greene County Board of Elections Democratic Commissioner Thomas Burke, that could change after absentees are counted this week. Nathan Mayberg reported in the Register Star the Columbia County Board of Supervisors last week approved $221,000 in repairs for three bridges in Austerlitz, Copake and Stockport. The contract for the work was awarded to Arch Bridge Contracting Corp. of Altamount, in Albany Co. Work is set to begin at the end of the month with the county Route 16 bridge over the Hollowville Creek in Claverack. Read the full story in the Register Star.

The New York State Police announced local troopers will participate in the National Child Passenger Safety Week, from Sept. 16 to 22, in an effort to draw attention to the threats faced by child passengers in motor vehicle crashes. NYSP indicated its intention to enforce the state safety belt laws through numerous checkpoints and daily patrols all this week. They will be especially focused on the proper restraint of children in vehicles, during this time. New York state law mandates the use of a safety restraints for children up to the age of 8. Parents and caregivers who need help installing a child safety seat or have questions about child passenger safety can receive hands-on educational assistance by making an appointment with a certified child passenger safety technician or attending a child safety seat check-up event.
