The Schoharie News reports that a second natural gas pipeline is proposed for Schoharie County, this one from Kinder-Morgan's North East Direct (owned by Tennessee Gas). This pipeline will follow a similar path of the Constitution Pipeline, along I-88. The Constitution Pipeline has already received approval from Federal Energy Regulatory Commission. There are two public hearings scheduled about this second pipeline, one April 6 in Schoharie at the Days Inn & Suites, and another April 14 in Richmondville at the Radez Elementary School. The Schoharie County Board of Supervisors passed a resolution last month opposing the use of eminent domain against county residents in pipeline matters. Another pipeline, the 178-mile Pilgrim Pipeline, is proposed to move Bakken crude oil from Albany to Linden, NJ, through Albany, Greene, and Ulster counties, and send refined crude back to Albany, largely along the I-87 corridor. In Greene County, the proposed project veers east of Route 9W west of Sleepy Hollow Lake in Athens, and then back near the interstate around Leeds-Athens Road. After Catskill, the pipeline veers west of the interstate briefly around Cauterskill Road. So far, Rosendale, New Paltz, Woodstock, and Rhinebeck have also passed measures opposing the pipeline. The village of Athens is considering many changes in their town code, including a proposed curfew for anyone younger then 18. The proposed language: "It shall be unlawful for any person under 18 years of age to be or remain in or upon any public street, avenue, sidewalk, alley, lane or public place in the Village of Athens after the hour of 9 p.m. in the evening unless such person is accompanied by his parent, guardian or other person having the legal custody of such minor person, or unless the employment of such minor person makes it necessary to be upon such street, avenue, sidewalk, alley, lane or in such public place during the nighttime after such specified hour. The Village fire siren will be sounded 15 minutes before the hour of 9 p.m. as a warning.” The last line has a line struck through it in the proposal. Governor Andrew Cuomo announced March 13 that the New York State Police will be taking extra efforts St. Patrick’s Day weekend to keep drunk drivers off the roadways. “State Police will be out in force to ensure a safe and enjoyable holiday weekend for all New Yorkers,” Governor Cuomo said. “Our message is clear: Be safe, act responsibly and there will zero tolerance for behavior that puts public safety at risk.” Drivers can expect increased road patrols from marked and unmarked cars, and sobriety checkpoints along roadways throughout the state, and a stepped-up effort to ticket distracted drivers using handheld electronic devices. Last year's similar effort resulted in 184 arrests for DWI and more than 11,000 tickets issued for traffic and other violations. The increased patrols run through Mon., March 16.

[caption width="229" align="alignright"] Don Weeks, from WGY.[/caption]• The Daily Freeman reports WGY (810-AM and 103.1-FM) announced March 11 that Don Weeks, the 30-year host of a popular morning talk show on the Albany radio station WGY, died at age 76. He began at WGY in December 1980, and was known as “Uncle Don.” Weeks won a Marconi Award in 2005 and was inducted into the New York State Broadcasters’ Hall of Fame in 2009.

• The Rip Van Winkle Amateur Radio Society's next meeting is at 7 p.m. March 16 at the Churchtown Firehouse, 2219 County Route 27, Hudson. They will be having an auction of radio equipment.

Vince Pecoraro is reporting in the Chatham Courier the Life Serve Youth Foundation’s efforts to open a youth summer tennis camp at 206 Thomas Road in Chatham have been rekindled. In a letter dated March 10 sent to the Chatham Town Clerk by the attorney representing the foundation, the foundation requested a hardship waiver under Local Law Number 1 of 2015. An application to the Zoning Board of Appeals for a special use permit by foundation founder and president Adam Stone to create the camp appears to have triggered passage of the law, which imposed a 12-month moratorium on special use permits for land along dirt roads. The town board must now hold a public hearing on the request. Following the hearing, the board has 15 days to make a decision. Pecoraro reported a representative of the Thomas Road Conservation Alliance, the group of neighbors opposed to the project, was not available for comment. Read the full story in the Chatham Courier.

William J. Kemble is reporting in the Daily Freeman speakers at a state Public Service Commission rate hearing Thu., Mar. 12, opposed proposed Central Hudson gas and electric rate increases to pay for infrastructure upgrades, but said they would support funding for projects like the development of microgrids powered by community solar energy installations. The hearing in Kingston attracted 25 people. Among those who spoke, concerns focused in part on the need to emphasize development of alternative energy sources rather than funding repair of equipment using older technology. Some spoke in support of the Community Choice Aggregation program, which allows for the development of microgrids. Central Hudson has proposed to increase electric and gas delivery rates, which are separate from the charges for the products themselves, over a three-year period. The utility also would use subsidies provided by its parent company to reduce the amounts. Read the full story in the Daily Freeman.

Casey Seiler at Capitol Confidential reports that a state senator and assemblymember introduced an email retention bill this week for state officials. Seiler is also reporting that Attorney General Eric Schneiderman has ordered his office to immediately suspend the 90-day automatic deletion policy put in place by his predecessor, now Gov. Andrew Cuomo. The order came in a memo from Schneiderman's Chief of Staff Micah Lasher. Lasher said the AG's counsel has been directed to formulate a new document retention policy. Schneiderman took heat over transparency last summer, when his office refused to release full records of communications between AG staff and political consultants. The AG’s office insisted the communications were exempt from FOIL because the consultants were serving as unpaid and uncontracted advisers. Bob Freeman of the Committee on Open Government called that argument “a stretch.” Official New York state emails are now purged after 90 days to avoid later scrutiny. Late Thu., March 12, Cuomo jumped on the story, telling Capital New York he wanted to convene a summit to look at the policy. “The 90-day email policy was implemented in New York State in 2007 by then Governor Spitzer's administration, and expanded to include the Attorney General's office that year,” Cuomo spokesperson Melissa DeRosa said. “We believe the policy should honor transparency while maintaining efficiency. To that end, as the Attorney General and the legislature appear open to revising their policies, the Governor’s office will convene a meeting with representatives from the legislature, the Attorney General and the Comptroller to come up with one uniform email retention and FOIL policy that applies to all State officials and agencies.”

Vince Pecoraro reports in the Chatham Courier that drivers in Canaan are getting flat tires because of potholes on state roads, according to Councilwoman Brenda Adams. Routes 295 and 22, in particular were named at a March 9 town meeting as crumbling, according to Supervisor Richard Keaveney and Highway Supervisor Bernhard Meyer. “The highway department is constantly talking to Hudson DOT, New York State DOT, telling them where certain issues are in these roads that are becoming a real hazard,” Keaveney said. “So the town does communicate these things. We don’t have the responsibility, but that doesn’t mean we don’t take the responsibility of informing them wherever the next big pothole is coming because we see it before they do.” Meyer says he has called the DOT in Chatham and Hudson, and the headquarters in Poughkeepsie. When that did not result in action, he called the governor’s office, who sent him back to Poughkeepsie after running him through emergency management. Now he's calling the offices of Assemblyman Steve McLaughlin (R,C,I,SC-Schaghticoke) and Sen. Kathleen Machione (R,C,I-Halfmoon). Read the full story in the Chatham Courier.

On March 11 the Federal Communications Commission fined Optic Internet Protocol, Inc., an Alpharetta, GA telephone company, $7,620,000 for changing consumers’ long distance carriers without their authorization (“slamming”), placing unauthorized charges for service on consumers’ telephone bills (“cramming”), and submitting fabricated audio recordings as “proof” that consumers had authorized the company to switch their carriers. “Consumers should be able to count on companies not to load their phone bills with phony charges” said Travis LeBlanc, Chief of the Enforcement Bureau. “The FCC will enforce the law to the fullest extent possible to stop companies from taking advantage of consumers by switching their telephone carriers and placing charges on their telephone bills without authorization.” Optic made up its own audio recordings to “prove” that consumers authorized changes in their services, and then played the bogus recordings for consumers and produced them for law enforcement. The FCC has taken nearly 30 enforcement actions for cramming or slamming in the past five years, with more than $90 million in penalties, and more than $200 million returned to consumers. On March 12, the FCC also announced its net neutrality rules, according to Dominic Rushe in The Guardian. The 313-page document includes, "new rules [that] ban internet service providers (ISPs) from blocking or 'throttling' any legitimate service online. The FCC also outlawed ISPs from creating fast lanes for preferred services – a practice known as 'paid prioritization,'" according to The Guardian story. High-speed internet is now classified as a telecommunications service rather than an information one, allowing the FCC to oversee broadband under Title II of the Communications Act of 1934. Four million citizens sent in comments about the proposal to the FCC, and President Obama also made a public comment that he was in favor of net neutrality. Republican FCC commissioner Ajit Pai said he did not hear the public comments, only the president's words. “We are flip-flopping for one reason and one reason alone: president Obama told us to do so,” he said. In a statement, the FCC said, “The order bars the kinds of tariffing, rate regulation, unbundling requirements and administrative burdens that are the hallmarks of traditional utility regulation. No broadband provider will need to get the FCC’s approval before offering any price, product or plan.”

Siobhan (SHIV-on) Barton is reporting in the Register Star the Columbia County Board of Supervisors Wed., Mar. 11, authorized the transfer in ownership of Pine Haven Nursing Home and Rehabilitation Center to Premier Healthcare Management. The Long Island-based, for-profit company has offered $6.5 million for the facility. Pine Haven is a 120-bed nursing facility located in Philmont, now owned and operated by the county and licensed by the New York State Department of Health. Supervisors Clifford “Kippy” Wiegelt, Raymond Staats and Edward Cross cast the only dissenting votes on the resolution to privatize the facility. Al Wassenhove, community activist and chairman of the "Save Pine Haven" Committee called it a sad day. He said, "I'm ashamed of my county government." Prior to the vote, Wassenhove made a final appeal to the full board, and requested the decision be put off for 30 days. He predicted a staff reduction of at least 25 percent at the facility following the sale. Read the full story in the Register Star.

Arthur Cusano is reporting in the Register Star officials have determined the cause of the fire on State St. in Hudson that left three families homeless last month. The Feb. 28 blaze was a result of a fire started earlier that same evening by a child in one of the apartments, according to Hudson Police Chief Edward Moore. While playing with a lighter, the child accidentally ignited a teddy bear, then threw the stuffed toy onto a bed. The bedding, wall, clothing and mattress then caught fire. The fire was extinguished without the help of city firefighters, and the items were deposited in a large garbage bag and placed on the back porch. That bag reignited at 10:40 p.m., eventually engulfing the two structures located at 336 and 338 State St. “We are very, very sure that this is what happened,” Moore said Wed., Mar. 11. Hudson Fire Department Chief James Schermerhorn (SKEM-er-horn) said the residents should have called his department when the initial fire occurred, even if they thought it had been properly extinguished. Reignitions are common occurrences, he said. Criminal charges have not been filed. Read the full story in the Register Star.

Brittany Horn is reporting in the Times Union exactly one week after thousands of charter school students closed downtown Albany streets, an estimated 2,000 parents, students and teachers marched down State St. to the state Capitol, in support of traditional public schools. The rally and march held Wed., Mar. 11, was organized and funded by the Alliance for Quality Education. Participants called for a $2 billion increase in state funding from Gov. Andrew M. Cuomo and the state Legislature. Students from Cohoes, Schenectady and East Greenbush participated in the rally, but students from across the state were represented as well. Alliance Executive Director Billy Easton said the event Wednesday served as a field trip for students and an opportunity to learn about participatory democracy. Scott Waldman in Capital New York reports that federal regulators say the proposed transmission project on the Hudson River from Canada to New York City can be exempt from rules regulating the state's energy markets. The Federal Energy Regulatory Commission reversed a November determination from the state's independent grid operator saying that the project was not exempt from the rules regulating the energy markets. Albany-based Tranmission Developers Inc. (T.D.I.) appealed, asking the feds for an exemption. The proposed 333-mile transmission line would bring Canadian hydropower to New York City, and spokesman Sean Klimczack says the project now has received final state and federal permits needed to begin construction, but no starting date has been announced for constructing the $2.2 billion project. RWM is a radiophonic project of the Museum of Contemporary Art Barcelona (MACBA) that explores the possibilities of the internet and radio as spaces of synthesis and exhibition. The broadcast, at 8 p.m. Sat., March 14, features works by Hank Bull and Felix Kubin, as well as David Crowley's look at Oskar Hansen's links to the twentieth-century Polish electroacoustic scene, and the role of the experimental radio studio in Warsaw at the time; Franco Berardi remembering the days of Radio Alice, a legendary free radio in the seventies; Lawrence Abu Hamdan exploring the contemporary politics of listening and the role of the voice in law; and reintrepretation of Samuel Beckett's play 'Cascando', by Joan Morey.
1 a.m.: Selected Songs: Quintron From Wikipedia: "Quintron (real name Robert Rolston; born circa 1967, Germany) is an American musician and leader of the eponymous one-man-band, "Quintron". He is a celebrated nightclub organist and inventor, who has patented a number of his own inventions and often performs at his own private club, the Spellcaster Lodge, located on St. Claude Avenue in New Orleans’ 9th Ward. He frequently performs with his wife, fellow musician and puppeteer, Panacea Pussycat (also known as Miss Pussycat), co-founder of the 9th Ward's now defunct Pussycat Caverns. [caption width="250" align="alignright"]Marvin Gaye, from Wikipedia.[/caption]The Guardian reports that a jury awarded Marvin Gaye’s children almost $7.4 million on March 10, determining Robin Thicke and Pharrell Williams copied Gaye's 1978 hit "Got to Give it Up" to make "Blurred Lines," the biggest hit song of 2013. Anyone comparing the two tracks can hear the similarities. The jury, though, did not listen to the actual songs, but heard a version of the original Gaye song made from sheet music. Thicke, before the lawsuit, told GQ magazine that one of his favorite songs was "Got to Give It Up" and that he told Williams that they should write a song with the same "groove." Then he said he lied, and didn't have anything to do with writing the song. Surprisingly, several notable musicians and internet writers defended the "remake." Tom Petty's keyboardist Benmont Tench tweeted, "I disagree with the verdict, I think they took production and arrangement ideas but not the actual song."

Michaelangelo Matos writing at Deadspin, quoted legendary critic Lester Bangs to defend the second take:

"According to one theory, punk rock all goes back to Ritchie Valens's 'La Bamba.' Just consider Valens's three-chord mariachi squawk up in the light of 'Louie Louie' by the Kingsmen, then consider 'Louie Louie' in the light of 'You Really Got Me' by the Kinks, then 'You Really Got Me' in the light of "No Fun" by the Stooges, then 'No Fun' in the light of 'Blitzkrieg Bop' by the Ramones, and finally note that 'Blitzkrieg Bop' sounds a lot like 'La Bamba.'"

Still, hearing even faux copies of the songs, they sound awfully similar. “The jury up there, they didn’t have to go our way,” Nona Gaye, Marvin Gaye's daughter, said after the verdict. “They copied ‘Got to Give it Up’ and [the jury] heard it! Which was very important. They heard it, you know. It wasn’t just us.”

Parry Teasdale is reporting in the Columbia Paper the proposed $11.3 million capital project put forward by the Germantown Board of Education was defeated Tue., Mar. 10. The referendum drew 657 voters. The rejected proposal covered 27 items, including a new auditorium, new band and theater arts rooms, restrooms, adding spectator seating to the elementary school gymnasium and relocating the outdoor basketball court and playground. The resulting property tax increase was projected to be 36.7 cents per $1,000 of full value, so a property owner with a home assessed at $200,000 would have paid $6.12 more per month in school taxes, or $73.40 a year, beginning in 2021. Superintendent Susan L.S. Brown in a written statement released following the vote thanked the members of the volunteer Community Facilities Committee for their work in formulating the project. The board will next meet March 18, at which time members could indicate if a second vote on a modified proposition will be considered.
