• The Federal Communications Commission is waiting to see if the Federal government will be open on Tue., October 1, and David Oxenford at Broadcast Law Blog writes about what might happen. Congress needs to pass a “continuing resolution” to keep the government running at current levels, and that is in doubt. No plan for a shutdown has been announced yet, but under a plan for 2011, when the government last came within hours of a shutdown, all of the FCC’s workforce would need to go home, and could not perform any functions while the government is closed. "There will be no construction permits issued for new or improved stations, and no grants of other pending applications – including assignments and transfers – meaning that sales of stations would be in limbo for however long the shutdown lasts.... And, in most other shut-downs (or in shutdown planning), the Commission’s staff was not even allowed to voluntarily do anything related to their official business - so they could not answer emails or phone calls from home, or travel on their own dime to anything related to their official functions," Oxenford wrote in Broadcast Law Blog.

• Stopwatching.Us, a coalition of more than 100 public advocacy organizations and companies, including Electronic Frontier Foundation, American Civil Liberties Union, National Libertarian Party, and others are organizing two days -- Oct. 25 and 26 -- of lobbying Congress and a mass rally in Washington D.C. against the surveillance state. Oct. 26, the day of the rally, is the 12th anniversary of the Patriot Act's signing.

• RiaNovosti reported last week that Voice of Russia is closing its shortwave service. Now, VOR has released a vague response: “Unfortunately, so far we have no official information as regards the cancellation of shortwave broadcasting. However, we cannot rule out such a scenario for the future, since currently the VOR is speedily introducing modern day technologies of radio and internet broadcasting.”

• "Free Speech Radio News" aired its final broadcast Sept. 27, after beginning in January, 2000, and currently airing on over 90 radio stations.

REC Networks reports that at the Sept. 26 Federal Communications Commission monthly "open meeting" the Audio Division staff presented to the full Commission an update on the progress of the Auction 83 translator processing and the upcoming LPFM window. "All but eight translator applications have been given an opportunity to file a long form application or settlement related change," REC reported. The FCC also announced that the first singleton Low Power FM applications (those that do not face any competing applications) will be processed in mid-January, 2014 and MX groups (competing applications) will be announced later in 2014. REC will have predictive information on MX applications posted after the FCC publicly releases the information about the applications. FCC officials also reported how cleaning up the translator issues were going ahead of the LPFM filing window.


Paul Lewis and Dan Roberts in The Guardian reports about the Senate Intelligence Committee hearing Sept. 26, discussing potential legislative changes to the Foreign Intelligence Surveillance Act (FISA), the law that governs a large portion of electronic and phone surveillance by intelligence agencies. Several Senators are proposing changes to the law. Director of National Intelligence James Clapper, National Security Agency Director Gen. Keith Alexander, and Deputy Attorney General James Cole were among those testifying about the surveillance program. Alexander and Clapper refused to say on the record where the NSA had ever sought to trawl cell site data, pinpointing the location of individuals via their phones.

Paul Lewis and Dan Roberts in The Guardian report that on Sept. 25, several Senators combined various legislation recently being proposed to rein in United States government surveillance, into the Intelligence Oversight and Surveillance Reform Act. Ron Wyden (D-Oregon), Rand Paul (R-Kentucky), Mark Udall (D-Colorado), and Richard Blumenthal (D-Connecticut) introduced the bill. The Act would prohibit the NSA's bulk collection of phone records of Americans under section 215 of the Patriot Act, and close a so-called "back door" that potentially enables the NSA to intercept the internet communications of Americans swept up in a program protected by Section 702 of the of the FISA Amendments Act. Russia Today reports that Senator Dianne Feinstein (D-California), who is the chairperson of the Senate Intelligence committee, will introduce a weaker bill that would not limit the current scope of NSA surveillance.

Howard Reich in The Chicago Tribune reports that among the 24 winners of the 2013 MacArthur Fellowships, or “genius grants,” announced on Wed., Sept. 25, there are several radio-related artists.
Each winner receives $625,000 over a five-year period, with no strings attached (an increase from the $500,000 amount of previous years). Since 1981, the Chicago-based John D. and Catherine T. MacArthur Foundation fellowships have been selected by a secret process for which no one may apply. This year's winners include 13 men and 11 women, from 32 to 60-years-old.

Jeremy Denk, 43, New York, is a concert pianist who plays standard repertory and 20th-century works, and writes in The New Yorker, The New Republic, and other publications.
Carl Haber, 54, Berkeley, Calif. Experimental physicist Haber has invented new means for recapturing fragile aural documents. Recordings made on wax cylinders, lacquer discs, and other historic technologies have been retrieved by Haber and colleagues using a non-contact technique that transforms visual data into a digital sound file.
Vijay Iyer, 41, New York. Jazz pianist brings the sounds of his Indian heritage in jazz improvisation and composition.
Dina Katabi, 42, Cambridge, Mass. Katabi, a professor at the Massachusetts Institute of Technology, and her collaborators have created ways sending radio waves faster, more safely and more securely. She has, "shown that Wi-Fi signals can be used to read the movement of a person's body, enabling a computer to receive instructions delivered by gesture rather than by keystroke."

Friday Morning Quarterback, a radio trade magazine, reports that radio consultant firm Mark Kassof & Co. has revealed a portion of its annual ListenerThink P1 study, and the research shows that 70 percent of 18- to 64-year-old radio listeners agree with the statement: "If you couldn't listen to radio, you'd feel something important was missing from your life." Only 27 percent disagree, while 3 percent don't know. The study also said that 53 percent of 18-64-year-olds agree strongly or slightly that, "radio isn't as good as it used to be." The findings are based on 989 online interviews with radio listeners in the U.S., conducted in September.

• Eriq Gardner at The Hollywood Reporter writes that in a March 13, 2012 filing at the American Arbitration Association the National Football League demanded $1.5 million from M.I.A. for allegedly breaching her performance contract and tarnishing the NFL's goodwill and reputation by brandishing a middle finger while backing up Madonna during the halftime show at the previous year's Super Bowl. M.I.A. - born Mathangi "Maya" Arulpragasam - does not want to pay, though. On Sept. 23 she released this angry video on YouTube. Read the full story at The Hollywood Reporter.

• Michael Stocker in National Geographic Magazine reports on the increasing underwater, high-frequency sound pollution emitted from shipping noise, military sonar, acoustical beacons, and echo sounders, that is crowding out higher frequency bands that whales use to communicate, and many other fish listen to for predatory advantages. Now, the sharks have tiny transmitters on their fins. But, Stocker writes, things may be getting quieter. "While the ocean is getting louder with the sounds of mechanization and technology, it was not necessarily quieter before the industrialization of shipping," Stocker writes. "The ocean was probably a pretty noisy place before the 20th century due to biological noise. Since the industrialization of whaling and fishing millions of whales and perhaps 90 percent of all fish have been pulled out of the sea–along with all of their noises." "Free Speech Radio News," a show that included freelance audio journalism from around the world, will air its final show Fri., Sept. 27. The show ends because of a financial struggle. "Our major funder Pacifica has not been able to pay us and its past-due balance to FSRN is about $198,000," the show's board of directors said in a letter (printed in full below). "Our production currently costs about $36,000 per month. Until recently, your dollars supplemented a $25,000 per month contract with our major donor, the Pacifica Foundation. But our current contract is for just $10,000 per month, which is not enough to sustain daily production at current levels." The show emerged, in January, 2000, according to Wikipedia, as freelance reporters for the former Pacifica Network News engaged in a strike over censorship by Pacifica's then Executive Director and Board. The strike ended in March, 2002 when the board was replaced and "Free Speech Radio News," since then, received major financial support from Pacifica. The New York Times recently reported Pacifica owes more than $2 million in broadcast fees to “Democracy Now!.”

We write to you with some extremely sad news. Last Friday, FSRN’s Board of Directors issued a two-week layoff notice to all staff, with our last daily program scheduled for Friday, September 27th.

Our Board took this action because as of September 13th, FSRN had $32,000 in the bank. We project that in order to close up shop and meet our financial and legal responsibilities, it will cost $29,000.

FSRN is currently carrying just over $200,000 in accounts receivable. For much of the year, our major funder Pacifica has not been able to pay us and its past-due balance to FSRN is about $198,000.

Many of you have supported FSRN during our struggles to make ends meet. Over the years we have made significant cutbacks to respond to a shrinking budget and weathered several financial crises that nearly brought us to the brink of closure. Most recently, funds ran dangerously low this past Spring, but with your help, we raised more than $100,000 from more than 1300 people like you to keep FSRN on the air.

Today, we once again find ourselves in crisis.

For those of you unfamiliar with FSRN’s operating costs and revenue, we’d like to share a few details. Your grassroots support has been vital to FSRN. We are currently working hard to develop a sustainable business plan that will take FSRN into the next phase and we hope we can count on you for your support when the time is right.

The Federal Communications Commission has announced it will soon begin accepting applications for hundreds of new low-power FM radio stations in the United States in October. "Democracy Now!" included this segment on the news. Jeff Rousset, national organizer of the Prometheus Radio Project, and Ramon Ramirez, president of PCUN (Pineros Y Campesinos Unidos del Noroeste), the largest Latino organization in Oregon, are interviewed.

The Federal Communications Commission announced the rules for the upcoming Low Power FM ("LPFM") filing window, Oct. 15-29. The window is available for LPFM proposals in the entire FM band (channels 201-300). The Commission established the LPFM service in 2000 and more than 800 LPFM stations have been licensed from the initial 2000-2001 windows. The Commission recently modified a number of
LPFM licensing and service rules to implement the second Congressional Local Community Radio Act and allow this second application window, after Congressional opposition created tight rules in the original application period.

Each applicant must be a nonprofit educational organization, or a Tribe or
Tribally-controlled organization, or a state or local government or a non-government entity that will
provide a noncommercial public safety radio service to protect the safety of life, health, or property.4
Each applicant will be required to document its eligibility.5 Applicants also must be "local" as that term
is defined in the Commission's Rules.6
LPFM applications filed during this window must protect all FM, FM Translator, FM Booster
and TV Channel 6 authorizations. LPFM applications also must protect pending broadcast applications in
these services that were filed prior to the date of this Notice. Finally, LPFM applications must protect

existing vacant FM allotments.7 Consistent with established processing rules, an LPFM application that
fails to protect these authorizations, applications, and allotments will be dismissed with no opportunity to
correct the deficiency.8
Revised FCC Form 318.

By this Notice, the Bureau is also making available the revised FCC
Form 318, Application for Construction Permit for a Low Power FM Broadcast Station (April 2013
version). The revised form is effective immediately and must be used by all LPFM applicants. All
previous editions of the FCC Form 318 are obsolete and may not be used in the October 15-October 29,
2013, filing window.
Filing Requirements.

Those wishing to participate in this LPFM window must electronically
complete and timely file FCC Form 318, Application for Construction Permit for a Low Power FM
Broadcast Station. No fee is required when filing FCC Form 318.
Applications must be filed between October 15, 2013 and October 29, 2013. Applications filed
earlier in the window will not receive any preference over those filed later in the window. Applications
filed before October 15, 2013, or after October 29, 2013, will be returned. Incomplete and patently
defective applications will be dismissed without any opportunity to amend.9
Electronic Filing Instructions.

Applications must be filed through the Media Bureau's
Consolidated Database System (CDBS) online filing system. The CDBS electronic filing system has
numerous business rules and other edit checks to help ensure that filings are substantially complete when
filed. When filing a new or major change proposal, applicants must select "New station" or "Major
Change in licensed facility," respectively, on the Pre-form for Form 318 (Question 2 Application
Purpose).10 Instructions for use of the electronic filing system are available in the CDBS User's Guide,
which can be accessed from the electronic filing website at:

Applicants are encouraged to access the system and prepare their applications and amendments at
their earliest convenience. Applicants may begin to complete applications immediately. Applicants are
also encouraged to submit their applications early during the window to ensure proper submission. An
applicant may amend a filed application without limitation during the window by checking the Section I,
Question 3 box "Amendment to pending application."11 Applications and amendments filed during the

window will not be made available to the public until after the close of the filing window. To ensure the
security of its application, it is important that an applicant shares its CDBS account passwords with only
those individuals who are authorized to view and/or modify proposals in progress.
To complete the filing process, applicants must select the specific application under "Work in
Progress" and then click on the "File Form" button. Applicants that have successfully filed Form 318
will immediately receive a CDBS response similar to the following:

Applicants that believe they have filed correctly and have not received such a message from the electronic
filing system should log into their CDBS account and determine the status of the application. If the status
is other than "Ready" or "Filed," the application has NOT been properly filed and will NOT be processed.
Following the close of the window, the Commission staff will return and/or dismiss

applications and amendments not submitted in accordance with the procedures described in this
Public Notice. No curative amendments for such applications and amendments will be accepted
after the close of the window.
The Commission must receive electronically filed applications no later than 6:00 PM EDT on
October 29, 2013.
Finding an LPFM Station Channel.

Applicants may use the Bureau's LPFM Channel Finder to
help determine if a proposed transmitter site would meet minimum LPFM station spacing requirements.
This internet-based utility is available on the FCC web site at: http://www.fcc.gov/encyclopedia/low-
power-fm-lpfm-channel-finder. The LPFM Channel Finder incorporates certain technical changes
implemented by the LPFM Sixth Report and Order.12 The site also provides additional information on
the LPFM service, including the text of the Sixth Report and Order, specific rule requirements for LPFM
applicants, and methods to determine the coordinates of an applicant's proposed transmitter site. Please
note that the LPFM Channel Finder tool is intended solely to assist LPFM applicants in tentatively
identifying available FM channels.13 There is no guarantee that channels represented as "available" will
be technically acceptable at the time an application is filed. An applicant should consider using a
consulting engineer or a party familiar with the LPFM technical rules to determine the technical
acceptability of its application, particularly if the applicant is requesting a second-adjacent channel
spacing waiver.
Application Limitation.

Nonprofit educational organizations may not file more than one
application in this window. Tribal applicants may not file more than two applications. Not-for-profit
organizations or governmental entities proposing to operate public safety or emergency services may file
more than one application. However, applicants proposing public safety or emergency services must
designate a "priority" application if multiple applications are submitted. Non-priority applications will be
dismissed if competing applications are filed in the window. For applicants subject to the one application
filing limit, a second application filed by such an applicant in this window would be treated as a

"conflicting" application subject to dismissal under Section 73.3518.14 This restriction applies even
where more than one frequency is available at its proposed transmitter site.
Conflicting Applications. After the close of the LPFM filing window, in cases of conflicting,

i.e., "mutually exclusive," applications, mutual exclusivity determinations will be made with regard
to all timely and complete filings.15 Thus, unless the applicants propose a settlement, the Commission
will use a point system to select among the mutually exclusive applications.16 Applicants may claim a
point for the following criteria if the applicant: (1) has an established community presence of at least two
years; (2) pledges to originate locally at least eight hours of programming per day; (3) pledges to maintain
a publicly accessible main studio that has local program origination capability; (4) can certify that it
qualifies for a point under both the local program origination and the main studio criteria; (5) can certify
that neither it nor any party to the application has an attributable interest in another broadcast station; and
(6) is a Tribal Applicant proposing to locate its transmitting antenna site on that Tribal Applicant's Tribal
Lands.17
The comparative qualifications of applicants, i.e., maximum possible points awarded pursuant to
Section 73.872, are established as of the close of the filing window. While new and major change
applications may be amended without limitation during the filing window,18 amendments that would
improve the comparative position of these new and major change applications will not be accepted after
the close of the filing window.19

"Radia" is a network of international radio stations interested in creative and forgotten ways of making radio. Each week one station makes an episode for all the others. This week, from free103point9 and WGXC, Sam Sebren and Liz LoGiudice bring you a glimpse into the transmission of Anguilla rostrata, aka the American eel. Sebren and LoGiudice trace the eel’s story from the Hudson River to the Caribbean, sometimes by way of Europe and the Pacific. Sebren and LoGiudice look at the American Eel Project’s Hudson River Estuary Program. Teams of scientists, students, and over 200 community volunteers monitor and count glass eels at 12 HREP sample stream locations along the Hudson River in New York State in the United States. Each year, glass eels – the tiny, transparent young fish – navigate the Atlantic Ocean all the way from the Sargasso Sea to the rivers along the East Coast. Every March and April, these young fish migrate into the rivers and freshwater streams, where they mature for 20 years or more before returning to the Sargasso Sea to mate and die. This episode of “Radia” tracks their progress in the Hudson River, and around the world. The entire show serves as a metaphor for the “Radia” stations and weekly transmission.

Organizations may also apply for support to travel within New York State to visit facilities that already have made this conversion.

This opportunity is meant to serve the NYS media arts community at large and will entertain proposals relating to a variety of Digital Conversion Planning issues and needs. Proposals may include, but are not limited to, planning and research for equipment conversion for film houses as well as collection management and equipment planning for all sub-genres of the media arts.

Keynote address, from Trans-X Transmission Art Symposium, live from Toronto. "Radio In Its Place - Here There Nowhere Now," by Steve Bates. In this talk, Steve Bates will discuss some of his recent projects that include site-specific recording, questions of threshold and border, residues of colonialism, silent broadcasts, sonic infiltrations and transmission. These projects include low-power productions in Dakar, and Ndar/Saint-Louis, Senegal and on Austria’s national state radio network. While different in their range and context, these investigations with site-specific sound geographies relate to a larger whole. The colonial history of longitude connects the project Radio 16º 16º to the site of Saint-Louis where site-specific recordings were collected as the raw material for low-power broadcasts. The title, borrowed from the abbreviated coordinates of the city, indicate an influence of military concept and jargon on the everyday. A Year of Radio Silence is a project with multiple iterations that uses the idea of a silent broadcast as its primary material, here one that causes a grand piano in Austria’s state radio studio to resonate across the former colonial power. Steve Bates is an artist and musician living in Montréal. The sonic is always the starting point for his projects which are evocations of communication networks and systems, or expressions of spatial and temporal experience. Bates frequently uses sound material that is site-specific in an attempt to uncover place and how the sonic effects our experience of site. Time is measured, stretched, pulled at, ignored, and extended. His work has been exhibited in Canada, the United States, Europe and most recently, Senegal. Steve Bates works in the field, on the air and in museological/gallery contexts. These shifting territories reflect the content of his practice.

11:45 a.m. – 12:45 p.m.: "Radio on the Fringe"
Live from Toronto, from the Trans-X Transmission Art Symposium. Two works are discussed: "Radius RANGE: Local, Distant, Fringe," by Jeff Kolar & Meredith Kooisp. Radius' 2012 series RANGE: Local, Distant, Fringe explores the importance of place and proximity in the event of radio transmission and reception. Radius, the experimental radio broadcast platform based in Chicago, IL, USA, released a three-part, location-based commissioned series and booklet titled RANGE: Local, Distant, Fringe, which highlighted the economic, political, and technical dimensions of the electromagnetic spectrum. The artists involved in RANGE produced sound works for the three coverage areas of Local (Emilie Mouchous and Andrea-Jane Cornell "Rise & Shine"), Distant (Damon Loren Baker "Distant"), and Fringe (Rob Ray "Subject to Greater Uncertainties") in order to challenge issues of signal accessibility and question radio's role as a distribution tool. The three parts of the series are based on the proprietary mapping software that plots radio station coverage areas. The talk will present audio excerpts of the three episodes featured in the RANGE series, and Radius' curatorial vision for executing location-based broadcasts. "Interpelled," by Victoria Estok. Interpelled is an ongoing project exploring an innovative use of sound as a unique tool for creative activist intervention. Sound and voice can interrupt, influence, and intervene at key moments in ways other intervention art strategies can’t. Interpellation is the ways in which ideology speaks to the individual. My work with interpellation came from questions of morality in the face of the climate crisis. This led me to use hyper directional sound to inspire a level of reflection and dialogue I saw lacking around what I considered to be the world’s most pressing issue. During several one-on-one interventions at the annual 2010 UN climate talks I used a HSS (hyper directional sound speaker) to project specific sounds at individual conference attendees with the goal that the audio would be interpreted as the voice of their conscience speaking.

"Frequencies: Dawson City" by Andrew O’Connor. Part public sound installation, part narrative documentary Frequencies: Dawson City is project for a series of low watt FM transmitters laid out around Dawson City Yukon. It was commissioned by the Klondike Institute for Art and Culture as a part of their series The Natural & The Manufactured. The transmitters are all broadcasting on the same frequency and laid out in an array so that as you walk the installation with your radio tuned one transmitter starts to fall out of range as the next one is coming in. Each transmitter broadcasts a different collage of soundscapes and stories (played on a loop) that relate specifically where you are standing. The buildings, the landscapes, the stories and experiences attached to them, and how these memories resonate in a physical location. By employing random chance and juxtaposition, multiple narratives are combined in a way that creates a unique listener guided narrative experience. "Still Here," by Alyssa Moxley and Ramona Stout. Still Here is a soundscape of the island of Santorini, in the Cyclades, Greece, recorded and composed by the artists Ramona Stout and Alyssa Moxley. We have selectively edited our recordings from Santorini to create a sound map. It is fundamentally inaccurate, yet it is all drawn from the aural environment as it is today, and likely will be for many years to come. It is a soundtrack that glosses the extremes of silence and noise that have come to dominate the island and recreates a bygone era in which there existed a host of functioning communities like Vothonas, of which there are now very few. It is the result of our recording the pulse of a place that now exists in suspended animation, a place that is alive but not quite living.

"Expanded Radio" by Robin Koek. Expanded Radio (Robin Koek) - approaching the concept of 'radio' from the perspective of composition and the practice of sound art. The lecture deals with the possibilities radio allows for composers to work with non-lineair concepts of time, make instant global musical, connections through transmission and re-define concepts of the public space within their creations. It elaborates on how radiophonic concepts like interference, wavelength and tuning were translated to the domain of musicians within the work. "The Urban Score," by Marieke van de Ven. The Urban Score (Marieke van de Ven) - a lecture about the auditory characteristics of the city and the artistic values of urban sound in the context of electro-acoustic music. The lecture explains how sounds of the city are able to source and guide the process of composition and their conceptual values marking a context for the piece.

2 p.m. – 3 p.m.: "Issue Project Room Radio: Yarn/Wire & Pete Swanson, Eliminated Artist"
Recorded live at Issue Project Room in March 2012, celebrated piano/percussion quartet Yarn/Wire premiere "Eliminated Artist", a collaboration with electronic artist Pete Swanson. Best known as one half of the now-defunct noise duo Yellow Tears, Swanson has since embarked on solo projects that range between free guitar noise, dismantled techno, and electronic soundscapes. For “Eliminated Artist,” Swanson recorded improvised rehearsals by Yarn/Wire and worked with the ensemble to craft a repeatable framework for live performance. A combination of acoustic signal and rehearsal recordings were then constructed into a live electronic mix by Swanson during the performance.

4 p.m. – 6 p.m.: "Saturday Afternoon Show: Working Wage Update"
Laura Hadden and Tennessee Watson are at Wave Farm this spring as the 2013 season’s first Artists-in-Residence. Hadden and Watson’s project Wage/Working addresses the issues of income inequality and the concept of wage through a time-based transmission installation and a radio broadcast series on free103point9’s WGXC 90.7-FM. During their time in Greene County, these two accomplished radio producers and artists will be collecting stories and interviews with workers in Greene and Columbia counties regarding their jobs and their relationship to their work.

6 p.m. – 7 p.m.: "PiratesWeek: Low Power Hour"
After the Weekly Presidential Radio Address, this week on the show about pirate FM and shortwave radio, check out the CIDX, NASWA, and MARE. Pirates in the news this week include The Big Q fiale. A pirate radio mocumentary "People Just Do Nothing" is coming to BBC3 this year, and we take a look at the FCC Activities. ‭Select postings from the Free Radio Network, HF Underground and note stations logged per the Free Radio Weekly. Off Air Recordings include the stations of: Black Cat Radio, Radio Cinco De Mayo, Shrimp Boat Radio, and the euro pirate Radio Mustang. President Obama has nominated telecom biggie Tom Wheeler to chair the Federal Communications Commission, and nervous commentaries are proliferating across the blogosphere.

Joshua Fried is gathering support for his debut experimental album. Fried is the artist behind the project Radio Wonderland, and can be heard every Saturday morning at 10:30 a.m. on free103point9 (both online and radio station WGXC 90.7-FM).



Gamma Wave Color Mixer

Cammisa Buerhaus is a 2013 Wave Farm Artist-in-residence. She is seeking support for her new project the "Gamma Wave Color Mixer," which operates in tandem with her hand-built Chroma Color Organ.

The Sacremento Bee reports that 80 proposals related to radio-controlled drones in 39 statehouses across the country, according to the National Conference of State Legislatures. In New York, two Brooklyn Assemblymen introduced bills in Albany this past week. Christopher Robbins in Gothamist reports about Bronx Assemblyman Luis Sepúlveda's bill, which prohibits drone use to gather evidence, "except when authorized under a warrant issued by a court of record or justified by lawful exception to the warrant requirement." Sepúlveda released a statement, saying that he plans several other drone bills, "Banning drones from being armed; clearly defining what constitutes a drone; restricting the use of drones by private citizens; and streamlining the mechanisms to secure permits for responsible drone usage concerning its commercial applications." Tom Precious in The Buffalo News reports that Assemblyman Nick Perry’s legislation, would “protect New York state residents from unwarranted and unauthorized use of drones or other unmanned aircrafts to conduct surveillance upon them inside their homes or place of worship or within the closed confines of their property or other locations where a person would have an expectation of privacy.’’ The Buffalo News says the bill exempts patrols along the Canadian border to prevent illegal entry of people or drugs and other substances, and to counter a "high risk of a terrorist attack by a specific individual or organization based on credible intelligence determined by the commissioner of homeland security and emergency services.'' His proposal includes individual use for "lawful purposes, including recreational or hobby purposes.''
