Robert Gavin reports in The Albany Times-Union that state court officials are not releasing information about how just-elected state Supreme Court Justice Christina Ryba was rehired as an attorney for Presiding Justice Karen Peters, just after being fired from that job on the eve of election day. Shawn Kerby, an assistant deputy counsel who handles Freedom of Information Law requests, denied a Times Union ask for information about issue. "Please be advised that we have identified a five-page document and six pages of email records related to your broad request," Kerby said in a Dec. 22 email. "The records are exempt from FOIL as disclosure constitutes an unwarranted invasion of personal privacy, entails non-final, non-factual interagency materials and implicates statutory confidentiality protections." Nine days after being fired, Ryba was offered a similar position with Supreme Court Justice Michael Coccoma. On Jan. 1, the Democrat begins a 14-year term as a judge in the seven-county 3rd Judicial District, after defeating Republican Colonie Town Justice Norman Massry. Katie Kocijanski is reporting in The Daily Mail the Hudson River Skywalk is closer to reality. Earlier this month the Greene County Department of Planning and Economic Development received a $124,000 grant to support the project. Greene County, the Thomas Cole National Historic Site, the Olana State Historic Site, the New York State Bridge Authority and the village of Catskill are partnering on the project. It will allow for the design and construction of pedestrian improvements for the Rip Van Winkle Bridge. Cole site Executive Director Betsy Jacks said the idea came out of an economic development tourism action plan. “They had planned to establish a series of trails and routes connecting different places in the county,” Jacks said. The skywalk will provide visual access to the Hudson River and strengthen the connection with Olana, the village's historic center and its waterfront, as well as the Cole House, Jacks said. Sean Sawyer, president of the Olana Partnership said the walkway will allow for more recreational use of both sides of the river. “The network of pedestrian and bike access trails for the city of Hudson and village of Catskill would also be improved,” he said. Mike McAndrew is reporting in the Post-Standard Ambit Energy has agreed to refund nearly $1 million to more than 1,500 customers to resolve complaints about the company's billing practices. Ambit is one of the state's largest independent suppliers of electricity and gas for residential customers. The settlement followed an investigation by the state Department of Public Service's consumer advocate. Most of the money will be paid to 774 Ambit customers in central and eastern New York, according to Gov. Andrew M. Cuomo's office. Most of those refunds will go to upstate customers who live in counties where National Grid provides electric and gas service. Ambit is based in Dallas, Texas. Keshia Clukey is reporting at Politico New York on the impact the statewide test score moratorium is having on the local teacher evaluation process. In some cases, districts will have to go back to the negotiating table. The state Board of Regents this month put a hold on the use of test scores in teacher and principal evaluations during the next four school years. The state Education Department has since issued guidance to districts on how to manage the evaluation process without the use of exam scores, and will keep working with districts on implementing the ban. Eliminating the state exams from the mix means 60 percent of teachers' evaluations will now be be based on observations and 40 percent on local tests, depending on what is negotiated with local collective bargaining units. It is possible that some teachers could be scored based entirely on observation, while others would see no change at all, according to an Education Department official. Matthew Hamilton is reporting at Capitol Confidential U.S. Rep. Chris Gibson said in a radio interview Sun., Dec. 27, he is not ready to support pay raises in exchange for New York lawmakers working full time. “I’m not ready to sign up for pay raises for legislators right now,” Gibson said. In the conversation with Bill Samuels on 907-AM's Effective Radio, Gibson also said he wants to see term limits on the state Legislature. When Gibson was sworn into the U.S. Congress, the now possible GOP gubernatorial candidate pledged to limit himself to four terms, and he is leaving Congress after serving only three. He said Sunday, “Our first president felt so strongly about term limits that he self-imposed them. I think the reason this is important is the notion of being a self-governing people. We were never meant to have a permanent political class." Gibson said the way to begin is with a governor who will self-impose term limits and then codify the decision into law. The Kinderhook Republican announced in January 2015 he would not seek re-election in 2016. Gibson has not yet committed to a run for governor in 2018. Melanie Lekocevic writes in The Daily Mail the Athens Community Foundation recently announced 38 awards to 32 different groups, totaling more than $200,000. Since its inception 13 years ago, the foundation has awarded a total of $2 million to local non-profit organizations in support of local programming that benefits the residents of Athens in some way. The foundation was established as part of an agreement negotiated between Athens Generating and the town of Athens when the company’s plant was in the planning stages more than a decade ago. The company contributed funds to the foundation for a number of years, but has since met its obligation. Other corporate contributors include the Peckham Family Foundation and the Morgan Stanley Charitable Spending Program. Civic, sports, cultural, fraternal, educational and governmental groups are eligible for grant money. It has helped a variety of local events over the years, such as the Athens Street Festival, the Victorian Stroll and the town’s summertime movie night at the pool. The Daily Mail reported that former Catskill school superintendent Kathleen Farrell will receive more than $337,000 from the district in the coming year, according to the terms of a recently released severance agreement. Farrell's resignation is effective Dec. 31, but she has been on paid administrative leave since November. The full severance agreement was recently acquired by The Daily Mail under the state's Freedom of Information Law. Under that agreement, Farrell will receive an annual salary of nearly $176,000 through 2016. By January 2017, the district must also pay Farrell $24,000 in severance and more than $100,000 for accumulated sick and vacation days. She will also receive 90 percent of her health premium costs from the district for the duration of her retirement. Farrell and the board of education have remained mum on the reason for her rapid departure. The severance agreement offered little insight on the possible cause, saying only that "differences arose between the board and Ms. Farrell in relation to her duties" as superintendent, including the implementation of some provisions of her contract.

John Mason reported in the Register-Star an estuary education center could be coming to the southern embayment of Henry Hudson Riverfront Park in Hudson. Earlier this month, the city Common Council authorized the Hudson River Sloop Club to apply for a grant from the state Department of Environmental Conservation to fund infrastructure repairs and improvements to the embayment. If the application is successful, the council will offer a license agreement to the club to establish the center. The grant would include payment for the services of a landscape architect, materials for the project and the cost of construction, in addition to equipment for the center as well. The plan calls for the use of a former shipping container to be outfitted with windows, doors and a solar power system that would allow the facility to operate off the electrical grid. The sloop club has a steering committee of six members, and claims a membership of more than 200 people.

Michael Ryan reported in the Windham Journal in year-end business the Jewett Town Board chose to renew a two-year agreement with the town of Windham for emergency medical services. Under the pact with Windham, medical rescue calls will be answered all day, every day in Jewett and be available to transport the sick or the injured to one of four regional hospitals. Town board members approved the ambulance contract without debate. The board also renewed a three-year contract with the Greene County Department of Human Services for its nutrition program. The county and the town have partnered on the nutrition program since 1984. Under the program, weekday lunches are provided to seniors at the town hall and delivered to home-bound seniors throughout the week and on weekends. Jewett is home to one of five senior centers located in Greene County.

Jeanette Wolfberg reported in the Columbia Paper on the details of a conversation held earlier this month by the Hudson City School District about its proposed construction project. District voters go to the polls February 9 to decide the fate of the nearly $20 million project. The main features of the plan include the addition of 18,000 square feet of space to the intermediate school, the construction of a 400-meter track and additional upgrades to outdoor athletic facilities, the replacement of lighting fixtures, as well as plumbing, electric and fire safety upgrades. Two additional questions before the voters will ask if the new football field should have natural or artificial turf, and if the field should also have lighting to allow for night games. Those additional two items would increase the price tag by approximately $1.35 million. Still undecided is what upgrades should be performed at John L. Edwards Primary School, which the district may close in five years. Schools statewide undergo a building survey to evaluate health, safety and structural concerns every five years. The last such survey rated Hudson’s buildings “satisfactory.” As for the $20-million proposal, Superintendent Maria Suttmeier said, “We could have stopped at $10.7 million, but we didn’t. We don’t want to be shortsighted.”

Marie J. French reported in the Albany Business Review the companies behind two proposed natural gas pipelines are pushing New York's Department of Environmental Conservation for quick approval. "Bird migration patterns" are the latest reason that Cabot Oil & Gas and Kinder Morgan want quick approval for, respectively, the Constitution Pipeline and the Northeast Energy Direct Pipeline. If approved, both would bring natural gas from Pennsylvania to Schoharie County, with the NED pipeline continuing across Albany and Rensselear counties into Massachusetts. “If we don’t get something this year, with each day that passes, it becomes more and more difficult to meet our in-service date,” Constitution pipeline spokesman Chris Stockton said, referring to the second half of 2016, when the pipeline is scheduled to begin service. “We’re confident that we can still make our in-service date if we get approval before the end of the year.”

Holland Cotter reported in The New York Times American painter, sculptor, and printmaker Ellsworth Kelly has died at the age of 92. His death was announced Sun., Dec. 27, by Matthew Marks of the Matthew Marks Gallery in Manhattan. Kelly was associated with hard-edge painting, color field painting and the minimalist school. He was born in Newburgh, Orange Co., to an insurance company executive and former schoolteacher. He attended public school and went on to study art at Pratt Institute and the School of the Museum of Fine Arts in Boston. Kelly had lived and worked in Spencertown since 1970.

The Daily Mail reports that another local school superintendent was fired but given a large severance package, with no information about the reason for the removal. The Catskill Board of Education will pay former Superintendent of Schools Kathleen Farrell more than $337,000 through 2016, according to documents The Daily Mail obtained under the state’s Freedom of Information Law. Farrell resigned Dec. 31, and has been out on paid administrative leave since November. “That’s bull,” said Bob Couchman, of Catskill. “If you got fired would you get paid for the next year. It isn’t the whole truth that’s being told to the taxpayers. I think some of it is trying to be disguised or buried.” The only reason given in the documents The Daily Mail received said that, “differences arose between the board and Ms. Farrell in relation to her duties as Superintendent of Schools, including with regard to implementation of the provisions of the employment agreement (her contract) between the board and Ms. Farrell.” Read the full story in The Daily Mail.
