Elections in Hudson, Austerlitz Tuesday

The Hudson schools hold an election on a capital project, and the Austerlitz fire district votes on a new truck on Feb. 9. The Hudson schools vote is from noon to 9 p.m. at the John L. Edwards School in Hudson; the Greenport Pumper Co. No. 1 Fire House in Greenport; the Claverack Fire House in Claverack; the Stockport Town Hall in Stottville; and the Livingston Town Hall in Livingston. That vote is on the sale of Claverack School building, and whether to issue bonds to pay for improvements to the Hudson High School, M.C. Smith Intermediate School, and John L. Edwards School, and construction of an addition to the M.C. Smith Intermediate School. In Austerlitz, the vote about the fire truck purchase is from 6 to 9 p.m. at the Spencertown Fire House, 1 Memorial Drive, in Spencertown.

Hudson Schools Election
Feb 9, 2016: 12pm - 9pm A special election of the qualified voters of the City School District of the City of Hudson, Columbia County, New York will be held at the following polling places in the School District: School Election District No. 1: John L. Edwards School, 360 State Street, Hudson, New York; School Election District No. 2: Greenport Pumper Co. No. 1 Fire House, Route 23B in the Town of Greenport, Hudson, New York; School Election District No. 3: Claverack Fire House, Route 23, Claverack, New York; School Election District No. 4: Stockport Town Hall, Village of Stottville, New York; and School Election District No. 5: Livingston Town Hall, Livingston, New York; on Tuesday, February 9, 2016, between the hours of 12:00 o'clock noon and 9:00 o'clock p.m., for the purpose of voting on the following Resolutions of the Board of Education: PROPOSITION 1 (Sale of Claverack School Building): Resolution dated September 14, 2015 adopted by the Board of Education, authorizing the sale of the Claverack School Property, subject to referendum, and delegating certain powers in connection therewith to the President, the Superintendent of Schools, the District Clerk and/or the Business Manager of the City School District of the City of Hudson. PROPOSITION 2 (Proposed 2016 Capital Project): Bond Resolution dated December 14, 2015 adopted by the Board of Education; a resolution authorizing the issuance of serial bonds of the City School District of the City of Hudson in an aggregate principal amount not to exceed $18,495,000 pursuant to the Local Finance Law to finance the 2016 Capital Project, with an estimated maximum cost of $19,995,000, including improvements to the Hudson High School, M.C. Smith Intermediate School and John L. Edwards School and construction of an addition to the M.C. Smith Intermediate School; authorizing the levy of taxes, such tax to be levied in annual installments in payment thereof in such years and in such amounts as shall be determined by the Board of Education taking into account State Aid available therefor; authorizing the expenditure of such sums for such purpose; authorizing the expenditure of $1,500,000 from other available funds of the District to pay a portion of the cost of the Project; and delegating certain powers in connection therewith to the President of the Board of Education. The ballots will be in substantially the following form: PROPOSITION 1 Shall the Sale to Jeffrey Gibson (or his assignee) of the premises and improvements at 621 Route 23B in the Town of Claverack, Columbia County, New York, for a minimum purchase price of $380,000.00, be approved? Yes ______ No ______ PROPOSITION 2 Shall the bond resolution entitled "BOND RESOLUTION DATED DECEMBER 14, 2015; A RESOLUTION AUTHORIZING THE ISSUANCE OF SERIAL BONDS OF THE CITY SCHOOL DISTRICT OF THE CITY OF HUDSON IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $18,495,000 PURSUANT TO THE LOCAL FINANCE LAW TO FINANCE THE 2016 CAPITAL PROJECT, WITH AN ESTIMATED MAXIMUM COST OF $19,995,000, INCLUDING IMPROVEMENTS TO THE HUDSON HIGH SCHOOL, M.C. Yes ______ No ______ The School District, acting as lead agency under the State Environmental Quality Review Act and the applicable regulations promulgated thereunder (SEQRA), has completed its environmental review and, on December 14, 2015, has duly issued a negative declaration and has determined that the implementation of the unlisted action as proposed will not result in any significant adverse environmental impacts; NOTICE is also given that a copy of the text of such propositions may be obtained by any resident in the District during the fourteen days immediately preceding the Special Election, except Saturday, Sunday, or Holidays, at each of the school houses in which school is maintained, and the Business Office located at the Hudson High School, 215 Harry Howard Avenue, Hudson, New York, between the hours of 10:00 a.m. and 3:00 p.m. (EDST). NOTICE is also given that pursuant to Section 2606 of the Education Law personal registration of voters is required and no person shall be entitled to vote at said meeting whose name does not appear on the register of said School District or who does not register as hereinafter provided, or who is not registered to vote under the provisions of Article 5 of the Election Law. NOTICE is also given that for the purpose of preparing registers of the qualified voters of the City School District of the City of Hudson, Columbia County, Hudson, New York, the Board of Registration will meet at the John L. Edwards School, 360 State Street, Hudson, New York, on January 25, 2016, from 4:00 p.m. to 8:00 p.m. Only those qualified voters who are not registered under permanent personal registration on or before the last registration day found on the original or duplicate register or records or list furnished by the Board of Elections and have not voted at an intervening school district election shall be required to present themselves personally for registration. Such register, prepared pursuant to Section 2606 of the Education Law, will thereafter be filed in the office of the Clerk of the District where it will be open for inspection by any qualified voter of the District prior to the election during the hours of 8:00 a.m. to 4:00 p.m. on each of the five (5) days prior to and the day set for the election except Saturdays and Sundays. If the ballot is to be mailed to the voter, the completed application must be received by the Clerk no later than 4:00 P.M. prevailing time, seven days before the special election. If the ballot is to be delivered personally to the voter, the completed application must be received by the District Clerk no later than 4:00 P.M., prevailing time, one day before the special election. A list of all persons to whom absentee ballots shall have been issued shall be available for public inspection in the office of the District Clerk during regular office hours from 8:00 to 4:00 P.M. on each of the five days prior to the day of the vote (excluding Saturday and Sunday). Austerlitz Special Election Feb 9, 2016: 6pm - 9pm Spencertown Fire House 1 Memorial Drive | Spencertown, New York 12165 a special election of the qualified voters of the Austerlitz Fire District, Columbia County, New York, will be held at Spencertown Fire House, 1 Memorial Drive, Spencertown, New York 12165, in said Fire District, on the 9th day of February, 2016, between the hours of 6:00 o'clock P.M. and 9:00 o'clock P.M., Prevailing Time, for the purpose of voting by ballot on the adoption or rejection of the following resolution: BOND RESOLUTION DATED DECEMBER 28, 2015. A RESOLUTION AUTHORIZING THE PURCHASE OF A FIRE TRUCK FOR THE AUSTERLITZ FIRE DISTRICT, COLUMBIA COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $450,500, AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $250,500 BONDS AND THE EXPENDITURE OF $200,000 AVAILABLE CURRENT FUNDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. BE IT RESOLVED, by the Board of Fire Commissioners of Austerlitz Fire District, Columbia County, New York, as follows: Section 1. The purchase of a fire truck for the Austerlitz Fire District, Columbia County, New York, including apparatus and incidental costs, is hereby authorized at a maximum estimated cost of $450,500. Section 2. The plan for the financing of the aforesaid maximum estimated cost is as follows: a) By the issuance of not exceeding $250,500 bonds of said Fire District hereby authorized to be issued therefore pursuant to the provisions of the Local Finance Law; and b) By the appropriation and expenditure of $200,000 available current funds of said Fire District hereby authorized to be expended therefore. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is twenty years pursuant to subdivision 27 of paragraph a of Section 11.00 of the Local Finance Law. Section 4. The faith and credit of said Austerlitz Fire District, Columbia County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Fire District a tax sufficient to pay the principal of and the interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. Section 6. All other matters except as provided herein relating to the bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 9. Upon this resolution taking effect, the same shall be published in summary in Register Star, which is hereby designated as the official newspaper of said Fire District for such purpose, together with a notice of Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law. Section 10. This resolution is adopted subject to approval at a special election of said Fire District to be held on the 9th day of February, 2016. * * * * * The polls will be kept open for the purposes of voting during the aforesaid hours, and the proposition will be in substantially the following form, to wit: PROPOSITION Shall the resolution entitled: "BOND RESOLUTION DATED DECEMBER 28, 2015.
