Jim Planck is reporting in The Daily Mail Catskill town officials have announced Frederick A. Edwards III will cease operations of his composting facility located on Route 23A, just east of Palenville. Catskill Town Superivisor Joseph Leggio announced at a town board meeting Tue., Aug. 4, Edwards indicated he would terminate his business activities following a meeting with Code Enforcement Officer Elliott Fishman this week. The details of the planned clean-up of the site are being negotiated, and Edwards will enter into an agreement with the town of Catskill once an agreement is reached. Neighbors complained the town’s law on junk storage prohibited the retention of construction and demolition debris, and said the town had failed to enforce the local law. Edwards' composting facility is permitted and authorized by the state Department of Environmental Conservation. Gail Heinsohn is reporting in the Chatham Courier New Lebanon Town Clerk Colleen Teal has successfully forced a Republican primary against incumbent town supervisor Michael Benson in September. Benson challenged the validity of Teal's nominating petitions with the Columbia County Board of Elections on the issue of residency. In a decision last week, Acting Supreme Court Judge Richard Koweek found in favor of Teal, saying she had provided sufficient evidence to support her claim of residency. Following the ruling Teal said she was glad New Lebanon GOP voters will now have the opportunity to choose their candidate in September. Benson said Teal's testimony clearly demonstrated she is not a resident of New Lebanon, and called on her to "end the deception on an immediate basis." Read the full story in the Chatham Courier.

Scott Waldman is reporting at Capital New York advocates claim low-income people are being shut out of the state’s process of reforming the energy grid. The state Public Service Commission is in the process of remaking the state’s energy grid to make it more efficient and more reliant on renewables. Low-income advocates are concerned that simply adding renewable sources could drive up energy bills and shut out poor communities. PSC chair Audrey Zibelman has repeatedly said the state will prioritize the needs of low-income community as it remakes the energy grid as part of the Reforming Energy Vision initiative. But at a meeting last week, the input largely came from utilities and larger advocacy groups not from low-income people. A spokesperson for Alliance for a Green Economy said the REV low-income proceeding does not address the growing unaffordability crisis faced by the state’s neediest residents, some of whom spend about 40 percent of their income on utility bills. Advocates are calling on the state needs to hold a series of public hearings at accessible locales across the state. They recommend that now is the time to reach out, as ideas become policy. Rick Karlin in Capitol Confidential reports that The Empire Center has released a new list of pork barrel spending on projects under the State and Municipal Facilities Program. The program replaced what were once called "member items," and are largely local grants for initiatives like park improvements or museum overhauls. Fewer than 10 percent of the items are for infrastructure like water or sewer system improvements or road repairs. In Greenville, in Greene County, there's a $50,000 pending grant for town park improvements. In Columbia County, the towns of Hillsdale and Stockport are approved for $50,000 construction projects, and the Niverville Fire Department has a pending $50,000 for a new fire truck. The Associated Press reports in The Daily Freeman that the Second U.S. Circuit Court of Appeals in Manhattan reinstating a lawsuit Aug. 4 brought by truck drivers who claim the New York State Thruway Authority charges excessive tolls. The suit, from three commercial trucking companies, claims the state diverts tolls to fund maintenance and improvements for the New York Canal System. Jim Planck is reporting in The Daily Mail the battle over a Palenville composting facility continues. Route 23A resident Stella Martin said Mon., Aug. 3, her neighbor, Frederick A. Edwards III, is operating the composting facility in violation of the Greene County construction and demolition debris law and a town of Catskill local law. Martin said the town's law on junk storage prohibits the retention of construction and demolition debris, but the town is not enforcing that law. The facility is permitted and authorized by the state Department of Environmental Conservation. Edwards is currently under a signed Order on Consent from the DEC to remediate illegally placed fill affecting a wetland. Martin alleges she and her family have experienced health problems she attributes to the materials dumped on Edwards’ property. Last month, Martin and other residents requested the town board look into the details of the town law, asserting Edwards is operating outside of that law. She complained at recent town board meetings that her concerns are not being taken seriously. Martin is now questioning the objectivity of town officials because, she claims, debris from an old town bridge was stored on Edwards' property with their knowledge. Patricia Doxsey is reporting in the Daily Freeman more than half the people responding to U.S. Rep. Chris Gibson’s online survey on the proposed Iran nuclear deal support the congressman’s opposition to the plan. The Kinderhook Republican stated in a post on his Facebook page of the more than 4,000 people who took the survey, 55 percent supported his position while 42 percent indicated support for the proposed deal. Three percent of those taking the survey said they were undecided. Gibson has called the proposed deal “a real problem” that makes the U.S. look “desperate” and could lead to a new war. “I will vote against the agreement,” Gibson said on Facebook. Gibson said he is an original co-sponsor of a House resolution opposing the agreement that was signed July 14 between Iran, the five permanent members of the United Nations Security Council, Germany and the European Union. Congress began its 60-day review of the proposed pact, Mon., Aug. 3. Following that review, Congress can vote to accept or reject the deal, or do nothing. Read the full story in the Daily Freeman.

Public News Service is reporting environmentalists are raising a stink over a loophole in proposed regulations for reporting overflowing sewage systems in New York state. Every year, heavy rains cause billions of gallons of bacteria-laden raw sewage to overflow from sewer systems into lakes and rivers across the state. Elizabeth Moran, Water and Natural Resources Associate at Environmental Advocates of New York, says the rules proposed by the state's Department of Environmental Conservation (DEC) would not require reporting from systems that don't have meters or computer models to measure or estimate the size of a spill. "That's a lot that would potentially go without reporting," she says. "We've seen already that if it's not clearly defined by DEC that they have to report, they won't." Moran says a DEC spreadsheet shows some counties have not reported a single spill since the Sewage Right to Know law was passed in 2013. The Environmental Advocates group wants the DEC to require reporting of all overflows, and a stronger system for notifying the public. According to the DEC, more than 900 New York communities have systems susceptible to discharging untreated sewage during rainstorms. Moran says such spills are suspected in at least one death. "In Buffalo, there was a resident who went swimming in a lake where there had recently been a sewage overflow, and he actually died from a bacterial contamination," says Moran. She says the Sewage Right to Know law is an important step in protecting public health, but the real solution lies in upgrading New York's antiquated drinking-water and sewage infrastructure. Jeanette Wolfberg is reporting in the Columbia Paper Sumayyah Shabazz is the newest member of the Hudson City Board of Education. Shabazz fills the vacancy created by the resignation of Peter Rice. She will serve through May 17, 2016. The district issued an open call for applicants, and Shabazz was the only person to come forward. Originally from New York City, Shabazz has resided in Hudson 15 years -- her youngest child graduated from Hudson High School last year. She was employed by the school district as a substitute teacher for four years and served as a counselor at Berkshire Farm for 12 years. Matthew Hamilton is reporting at Capitol Confidential state Attorney General Eric Schneiderman announced Mon., Aug. 3, he will for the first time use his special powers to investigate the death of a civilian in police custody. Schneiderman will examine the circumstances surrounding the death of 42-year-old Raynette Turner. Turner was found dead in a holding cell in Mount Vernon on Mon., Jul. 27, where she had been awaiting arraignment on charges of shoplifting. Schneiderman was given power to look into and prosecute police killings of civilians last month under an executive order issued by Gov. Andrew M. Cuomo. Rick Karlin reported at Capitol Confidential the rates for health insurers statewide next year will likely rise anywhere from 2 to 16 percent, depending on the plan, based on the information released by the state Department of Financial Services, Fri., Jul. 31. The approved increases were below the amounts initially requested by insurers. Anthony J. Albanese, Acting Superintendent of Financial Services, said: “We closely analyzed each insurer’s request and cut rates that were excessive or unreasonable. The influx of new consumers into the health insurance market in recent years means that rates for individuals will continue to be nearly 50 percent lower than before the creation of New York’s health exchange." John Mason reported in the Register-Star a federal lawsuit has been filed against Columbia County Undersheriff John Davi and four Hudson police officers by two Greenport men. The two men, both 19 years old at the of the incident, allege they were beaten by Davi when they were detained by the police. The civil action was filed July 29 by Brooklyn attorney Leon Glickman on behalf of Thomas Ohlerich [OLE-rick] and Nicholas Barto in the U.S. District Court for the Northern District of New York. The plaintiffs charge that not only was Davi guilty of assault and battery, but that he also used his position to avoid arrest and to gain the assistance of the Hudson police officers. In addition to Davi, Hudson police Lt. James Delaney, Sgt. Dean Rowe, officers Kevin Sweet and Nicholas Pierro were also named as defendants. It is alleged that after being approached by the four Hudson police officers in September of 2014, the plaintiffs were ordered out of their car and subjected to a search. Although the officers found nothing illegal, the men were detained against their will. Learning that Davi's son, Zachary, was one of the young men in the car, the city police called the Undersheriff to the scene. The plaintiffs allege that Davi smelled of alcohol when he arrived, and that Pierro, Sweet and Delaney taunted and threatened them. All five defendants are charged with false arrest and imprisonment, and with the use of excessive force.

Audrey Matott reported in The Daily Mail Cairo town residents, business owners and officials filled town hall Thu., Jul. 30, to voice their support and concerns regarding the proposed town zoning law. The opinions expressed were a mix of those who supported the proposed zoning law and those who felt the pending law was too much too soon, and too restrictive both for existing and potential new businesses. Galen Joseph-Hunter reported for WGXC many small business owners opposed a part of the proposal that limits building expansion to 25 percent for pre-existing businesses of types not permitted based on the proposed zoning map, which outlines where specific types of activities may take place. John Mason reported in the Register-Star the New York State Office of Parks, Recreation and Historic Preservation has determined that Hudson’s North Bay shacks, sometimes known as the Furgary Boat Club, are eligible for inclusion in the National Register of Places of Historic Significance. This comes at a time when the city of Hudson has been moving toward tearing most or all of the structures down. The report found the shacks are significant in the areas of maritime history, social history and architecture. While the 17 cabins most recently had recreational purposes, they evolved from buildings that were in place more than a century ago, when the property was a river’s edge fish market, according to the report. Tim O’Connor, of the South Bay Task Force, said he was not sure what it meant for the shanties to be “eligible" but, he said, he was happy. “I would say thank goodness there’s a state agency that’s above politics and took a fair look at this and recognized something of value,” O’Connor said.

The Confederate flag is flying over the Ulster County Fair this weekend. After Gary Newkirk, the fair manager, first told The Watershed Post that they would not allow the flags, they issued a press release saying that Confederate flags are allowed at the Ulster County Fair. "When the Watershed Post called Newkirk asking for an explanation about the discrepancy between his two statements, an aide in his office refused to put Newkirk on the phone and then hung up," the online journal reports. They also quoted Delaware County Fair officials welcoming the flags at their fair in a few weeks. In Greene County, Richard Bear, the former head of the Greene County Youth Fair, told The Watershed Post that there was no formal ban on Confederate flags at this year’s event. “We didn't have T-shirt vendors, or vendors of any sort that I think would portray that,” Bear said. "I don't care one way or the other. It's a part of history." The State Fair has banned the flag this year. Read the full story in The Watershed Post.

Parry Teasdale in The Columbia Paper reports that an Interim Report released from the state Public Service Commission July 15 eliminates 14 of 22 proposals for new or upgraded high voltage electricity transmission lines through the Hudson Valley. But several of the eight remaining projects run through parts of Columbia County. One group still remaining includes, "all the electric utilities that serve Columbia County," according to The Columbia Paper. But the Interim Report says that even though these proposals might be the “most environmentally compatible of the proposed projects… [they] may still represent significant impacts that will warrant mitigation.” Governor Andrew Cuomo called for an “Energy Highway” plan to upgrade and expand the state’s electrical power grid in his 2014 State of the State address, and since then, local opposition to the proposals has grown, with a regional organization called the Hudson Valley Smart Energy Coalition including local historic sites, environmental groups, and municipalities calling the added transmission lines unneccessary. The PSC is now preparing a final report, expected sometime in September. "A final decision on what route or routes the power lines will take or whether any new lines are needed may come from the commission possibly as soon as the end of this year," according to The Columbia Paper.

OFF AIR As of last week the National Weather Service in Albany was claiming its WWF-48 weather radio station at 162.525 MHz would be back on the air Aug. 1. But July 29, the NWS issued a statement saying it now does not know when the weather radio will return. "We continue to work on clearing administrative details including permit and lease requirements. Unfortunately we have no firm date when the broadcast will resume."

OFF AIR Two WGXC programmers running for office will not host shows on the radio until after the November elections. Tom DePietro, no party, and Victor Mendolia, Democrat, are both running for Hudson Common Council president. DePietro co-hosted the "WGXC Afternoon Show" on Thursdays and the "Mambo Italiano" show once a month on Sundays, and Mendolia hosted "@Issue" every other Wednesday on the community radio station.
