Back in October 2007, the FCC opened a brief licensing window for full-power, non-commercial stations. FMC and our friends at Radio for People thought this would be the perfect (and rare) opportunity for community arts organizations to get on the dial. We worked to identify qualifying groups, letting them know about the possibility and assisting interested parties with the application process.

Now, the approvals are starting to trickle in. New York State "transmission arts" collective free103point9 was recently awarded an FCC license to launch a 3,300-watt FM radio station on 90.7-FM in Greene and Columbia Counties.

Freelance journalist and radio enthusiast Mike Janssen (who worked on and has written about the full power licensing process) recently interviewed free103point9's Tom Roe about how they plan to build a community-oriented radio station from the ground up.

I've just finished updating the Enforcement Action Database. The FCC's Enforcement Bureau has reported its field actions through mid-December, and as you can see, given any activity over the balance of the month, it is on target to meet and/or (most likely) beat the record enforcement year of 2007.

What does this mean? It depends on how you look at the data. Sure, the FCC's busting more pirates than ever, but does that really mean it's making a dent in station proliferation? A couple of major conclusions from the year-in-review are striking:

1. Most FCC enforcement is concentrated around geographic "hot spots" around the country. The top two are south Florida (most notably the Miami-Dade metroplex) and New York. If you add New Jersey in with NYC, the density of enforcement actions is about tied. It's not that far of a stretch to equate that with the density of existing pirate radio stations (i.e., they're not going away).

2. Although most of the enforcement occurs in these hot spots, the fact that enforcement takes place essentially nationwide makes the phenomenon of pirate radio a national one. I think it's just much less of a priority for some field offices than others.

3. There's a compelling trend this year in the timing of enforcement actions. Multiple field offices tend to go pirate-hunting around the same time of the month (often on the exact same days). If I had to guess, the FCC's mandate from D.C. is, "spend some time hunting pirates to show that we care," and the agents in the field mark a day or two on their monthly calendars to handle any pending complaints. (For what it's worth, there's no indication that the FCC's 15 month-old online pirate station reporting form is doing much good).

4. Finally, the primary tools of FCC enforcement remain, by and large, quite administrative. Station-visits and threatening-sounding certified letters are the field agents' ammunition of choice. It's worth noting that although the amount of monetary forfeitures has risen to 2006 levels, the FCC's expected recoupment for each enforcement action it takes is paltry; going pirate-hunting is a big money-loser for the agency. Note that the number of arrests and convictions have remained stable - and less than a handful at that. It would seem that those state laws criminalizing pirate radio are doing a whole lot of nothing.

In fact, looking at the raw data from which I compile the majority of my statistics, the Enforcement Bureau's been going after more serious unlicensed broadcasters, like those who potentially jam public-safety, maritime, and land-mobile two-way radio networks. This is a phenomenon that also appears to be on the rise. The FCC's much more quicker to bring the fiscal hammer down on those sorts of people, but they're the ones doing real harm.

The bottom line? 2009 will be a year of opportunity for unlicensed broadcasters. Without some sort of massive infusion of human resources, capital, and political will, the FCC simply doesn't have the strength to shut much of anything down. It's reached its enforcement capacity, and it's being overwhelmed. In that sense, we're winning.

President-elect Barack Obama is urging Congress to postpone the Feb. 17 switch from analog to digital television broadcasting, arguing that too many Americans who rely on analog TV sets to pick up over-the-air channels won’t be ready.

In a letter to key lawmakers Thursday, Obama transition team co-chair John Podesta said the digital transition needs to be delayed largely because the Commerce Department has run out of money for coupons to subsidize digital TV converter boxes for consumers. People who don’t have cable or satellite service or a new TV with a digital tuner will need the converter boxes to keep their older analog sets working.

Obama officials are also concerned that the government is not doing enough to help Americans — particularly those in rural, poor or minority communities — prepare for and navigate the transition.

“With coupons unavailable, support and education insufficient, and the most vulnerable Americans exposed, I urge you to consider a change to the legislatively mandated analog cutoff date,” Podesta wrote in a letter to top Democrats and Republicans on the Senate and House Commerce committees.

In a statement released Thursday, Rep. Henry Waxman, D-Calif., chairman of the House Committee on Energy and Commerce, acknowledged that the transition to digital television is not going well, and that millions of Americans could experience serious problems on Feb. 17.

"We also know that many Americans will experience difficulties connecting their converter boxes, that there could soon be a shortage of boxes, and that the federal government is not prepared to answer the many questions confused consumers will have. I am reviewing the President-elect's letter and will work with his team and my colleagues to address the problems created by this poorly managed program," he said.

The Greene/Columbia community radio project is a community-run media project, re-envisioning radio as an innovative platform for local participation. Our inclusive programming connects diverse voices, and distributes information across the public spectrum in New York's Greene and Columbia Counties.

free103point9 will launch a 3,300-watt community radio station with a radio art bent, in 2010 on 90.7-FM in Greene and Columbia (and southern Albany) Counties in New York.

The End of Television is a video program beginning when analog television ends. On February 17, 2009 the U.S. television broadcast signal will change over from analog to digital. No television will receive a signal without a special converter box. On February 17, The End of Television will air through analog broadcast TV on channel 2 in Pittsburgh. When broadcasters turn off their analog transmitters The End of Television turns it's analog transmitter on and broadcasts the program. Using a restricted and nearly obsolete medium (broadcast TV), The End of Television re-imagines the omnipresent idea of "broadcast yourself." We are accepting all videos submitted before the deadline and there is no submission fee. Last week House of Representative Democrats voted 137-122 to replace John Dingell (D-MI 15th District) with Henry Waxman (D-CA 30th District, pictured at right) as the chair of the Energy and Commerce Committee. Dingell, the longest-serving member of the U.S. House, was considered by many progressive Democrats as standing in the way of key legislation, most notably auto industry reform. The Commerce Committee also oversees the telecommunications industry, and Dingell had stalled the Local Community Radio Act of 2007, which would have created thousands of new Low-Power FM stations around the country. Dingell was not one of the 99 co-sponsors in the House, and had kept the bill stuck in Subcommittee on Telecommunications and the Internet. Maybe that's because Dingell regularly takes large contributions from LPFM's biggest enemy -- the National Association of Broadcasters. Waxman, on the other hand, did co-sponsor the LPFM bill, and back in 2000, was the main opposition to the limits on the first LPFM bill Congress passed, while Dingell believed the since-disproved fake CD of alleged LPFM interference the NAB produced. Waxman's appointment as chair doesn't guarantee anything, but his past record indicates he is an LPFM supporter.

Since the abundant proliferation of digital communication technology, our (living) space has been expanded, transformed, reshaped. In our everyday lives we increasingly connect to mediated interfaces, be it consciously or without knowing. Digital media is increasingly integrated seamlessly into all areas of everyday life and work. The so-called “virtual worlds” created in this way are merging ever more dynamically with our physical environment generating new hybrid spaces, becoming a fixed part of our reality themselves. Our cities are increasingly pervaded by data networks, watched over by cameras, skinned by media facades, populated by users of mobile communication devices carried around with every step. “City” itself has become a media space, a complex fabric, in which an immaterial layer of data is augmenting the urban landscape, both merging ever more seamlessly. Radiator continues its investigation into the way that artists engage with locality and site, real and virtual urban space. The “Wireless City” brings deep cultural changes and our traditional spatial coordinates are gradually being superseded by an enhanced network. Sharing their inferences and conclusions, artists are invited to reflect upon the challenges facing our freedom, the poetry of resistance and also the opportunities the “Expanded City” has to offer. The Bang on a Can Summer Music Festival at MASS MoCA (the Massachusetts Museum of Contemporary Art, North Adams MA) is an intense, visceral, hands-on immersion in contemporary adventurous contemporary music. We will write it. We will perform it. We will think about it and we will talk about it. The festival includes performance coaching, composition seminars, music business workshops, improvisation and more. There are daily performances in the museum galleries and free concerts in the North Adams community. Obama's FCC transition team is to be headed up by two of the smartest, hardest-fighting Net Neutrality advocates I know: Susan Crawford and Kevin Werbach. This bodes very very well indeed for American telcoms policy!

Ms. Crawford is a former partner of a Washington law firm that specializes in communications law and recently left the board of directors of ICANN, a group that oversees Internet domain-name registration. Mr. Werbach edited Release 1.0, a technology newsletter, and founded Supernova Group, a technology analysis and consulting firm.

The Obama transition team includes a number of former FCC officials, but under the conflict-of-interest rules adopted by the president-elect’s team, many may be barred from directly examining FCC issues.

President-elect Obama’s office said today that Ms. Crawford and Mr. Werbach are part of the Science, Tech, Space and Arts Team that will be directed by Tom Wheeler, a former president of National Cable and Telecommunications.

The Federal Communications Commission awarded non-profit arts group free103point9 a license for a 3,300-watt non-commercial FM radio station on 90.7-FM last week.

The new station, with studios envisioned in Cairo, Catskill, and Hudson, will broadcast local musicians and artists, as well as community news, and programs about local schools, history, agriculture, the environment, and more. An online version of the station will launch early next year and provide community members an opportunity to get involved while the FM station is in progress. The online radio broadcast will also feature local town meetings, high school sports championships, as well as local performances, lectures, workshops, and a broad spectrum of creative radio or radio art programs. Many local events will also be broadcast live on the FM station.

"Community radio is a unique volunteer-based media format," said Catskill resident and media educator Aliza Dichter, "This station will be a way for us to both boost our local economy and celebrate the diverse cultures in our area. We can deal with serious issues, have fun, and build bridges across our towns and across the two counties."

"We want to give members of the community a chance to take the microphone, go on the air, and talk about what is going on in Greene and Columbia counties," says free103point9 Program Director Tom Roe. "This is a special opportunity for this area, and all the talented artists, hard-working activists, and unique personalities here to become the local media."

During the day the station will feature weekly and monthly programs on topics such as gardening, hunting, schools, arts, music, politics, and other issues important to the community. There will be programs by youth and for children. Evenings will feature DJs and live broadcasts from events all over the two counties. Late nights and Saturdays will be filled with international radio art, experimental music, and special local broadcasts. "The week before elections we want to give every local candidate the chance to go on the air and give listeners specific reasons to vote for them," Roe says.

Critical support from this project began in 2007 with interest from local agencies and community leaders; small donations from individuals and families across the region made it possible to conduct the initial legal and engineering work for the application. Planning for the radio station is now underway with leadership from a Community Council that includes Haines Fall's Dharma Dailey (Ethos Wireless); Hudson artist Max Goldfarb; Hosneara Kader (Hudson Family Literacy); Debra Kamecke (Cairo Public Library); free103point9's Tom Roe; Alan Skerrett (Columbia County NAACP); Hudson Talbot (Catskill Community Center); and Andy Turner (Cornell Cooperative Extension Agroforestry Resource Center). Aliza Dichter (Catskill Community Center), Galen Joseph-Hunter (free103point9) and Kaya Weidmann (Germantown Community Farm) have also provided crucial efforts and support for the station project.

Based in an area between the huge New York City media market to the south and the Capitol District to the North, the villages and rural communities of Greene and Columbia Counties have little in the way of local broadcast media, with only occasional coverage in regional news. As a valuable complement to our various daily/weekly town papers, this Greene Columbia community radio station will be a unique forum for discussions, news, culture, and emergency information across our two Counties.

Artists and activists lack a central network here for letting people know about their work. Live performances from local venues will sometimes be featured in the evenings on the online web streams and the FM radio station. "We are looking forward to collaborating with the many extraordinary organizations in our area, and providing an opportunity for their programs to be on the air," says free103point9 Executive Director, Galen Joseph-Hunter.

"We've spent the year since we applied for the station building relationships with cultural, civic, and economic groups across the listening area. Partnering with groups that are already providing important services to our community is a key part of our strategy for getting the most value to the community out of having a new radio station," says Dharma Dailey. "The station will support media literacy and media production for groups like the Catskill Community Center and the Agroforestry Center, as well as schools, libraries, and local businesses. We are also interested in working with other broadcasters and news outlets to improve news coverage throughout Columbia and Greene counties."

free103point9 is a non-profit arts organization focused on establishing and cultivating the genre Transmission Arts. free103point9 activities support and promote artists exploring the many forms of "radio art" including works about the idea of transmission or using the physical properties of the electromagnetic spectrum. free103point9's programs include public performances and exhibitions, an online radio station, the free103point9 Transmission Artists, an artist residency program, grant opportunities, a distribution label, a sculpture garden, and an education initiative including a study center and online archive. This FM station will be the first radio station in the U.S. to focus on radio art (many stations in Europe and Canada do).

free103point9 will webcast a performance by avant folk musicians MV & EE with the Golden Road and local musician Jeremy Kelly at 9 p.m. Fri. Nov. 7 at The Spotty Dog Books & Ale at 440 Warren St. in Hudson, NY, and will be giving out more information about the new FM station at the performance. Admission is $5.

Initial fundraising and planning for the station, which should be on the air in 2010, will begin this winter. La Superette 2008 is looking for: Survival crafters, conceptual product makers, DIY game producers, micro distributors, fashion hackers, electro-gadget inventors. La Superette is an annual hybrid event mixing art, shopping, music, and community spirit. La Superette is not an ordinary exhibition or craft fair. We've opened the gates to Public Radio Makers Quest 2.0! MQ2 is a new initiative from AIR (www.airmedia.org), the Association of Independents in Radio, that builds on public radio's 2007 Talent Quest (www.cpb.org/talentquest). This time, we want you to let us know about a brilliant producer, reporter, or sound artist you think has the potential to stretch public radio beyond current broadcast boundaries. We’ll reward 12 of the nominees with $20,000-$40,000 each to experiment. Who do you know who can most surprise us by harnessing emerging digital tools and distribution channels to give new shape to the sound of public radio?
