New York part of coalition suing over national-emergency declaration

Feb 19, 2019 7:15 am
Amy Goldstein is reporting for the Washington Post a coalition of 16 states, including New York. filed a federal lawsuit Feb. 18, to block President Donald Trump's plan to build a border wall without permission from Congress. The complaint argues that Trump's decision to declare a national emergency is unconstitutional and seeks a preliminary injunction that would prevent the administration from acting on the emergency declaration while the case makes its way through the courts. The lawsuit was filed in the U.S. District Court for the Northern District of California. The suit accuses the president of "an unconstitutional and unlawful scheme," and says the states are trying "to protect their residents, natural resources, and economic interests from President Donald J. Trump's flagrant disregard of fundamental separation of powers principles engrained in the United States Constitution." In addition to New York, the states participating in the suit are California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, Oregon and Virginia. With the exception of Maryland, the governors of the complainant states are all Democrats. Read the full story in the Washington Post.
