Yang files suit against NY over primary decision

Joseph Spector is reporting for the Poughkeepsie Journal former Democratic presidential candidate Andrew Yang has taken legal action against the state of New York for its decision to cancel the presidential primary in June. Yang, a Manhattan entrepreneur, filed papers in federal court in Manhattan late Tue., Apr. 28, arguing the action infringes on voters' rights. The "unprecedented and unwarranted move" infringes the rights of Democratic voters because it "denies them the right to choose our next candidate for the office of President of the United States," the suit alleges. The state's Democratic election commissioners voted April 27, to remove 10 presidential candidates from the ballot except Joe Biden, the only actively campaigning candidate and presumptive nominee. The action taken angered supporters of several candidates, including Bernie Sanders."No one asked New York to cancel the election," said Jeff Weaver, a Bernie 2020 senior adviser. "The DNC didn’t request it. The Biden campaign didn’t request it. And our campaign communicated that we wanted to remain on the ballot." New York is the first state in the country to cancel its Democratic presidential primary. Democratic commissioner Douglas Kellner called the vote "a very difficult decision." But he said holding the primary would have been "unnecessary and frivolous" in the age of the COVID-19. Yang's lawsuit said the goal is not "to undermine the health and safety of New York voters or election workers, but rather seek to uphold their fundamental rights under the Constitutions of the United States and the State of New York."
