David Lombardo reports in Capitol Confidential that attorney's for President Donald Trump say the U.S. Constitution’s Supremacy clause does not allow New York to sue him, his children, and the Trump Foundation. New York Attorney General Barbara Underwood brought a lawsuit in June in state supreme court alleging the president’s foundation broke charity laws, using donated money for his campaign. Attorneys representing the Trump Foundation moved to dismiss the action Aug. 30. The legal site Law Shelf says, “Since the president holds an important federal office and is responsible for executing the supreme law of the land, President Trump’s attorneys argued that a state court decision adverse to him would appear to take precedence over him." The attorney general’s office must respond by Oct. 4 and a conference with the judge in the case will happen a week later. “We won’t back down from holding President Trump and his associates accountable for their flagrant violations of New York law,” attorney general’s office spokesperson Amy Spitalnick said.
