Melanie Lekocevic is reporting for Capital Region Independent Media the Coeymans Town Board is looking to make changes to the local Clean Air Law. A proposed amendment to the existing law would take oversight of emissions of waste burning out of the hands of local government and make it the responsibility of state and federal agencies only. A public hearing will be held this month to receive public input on the proposal. The existing local law was adopted under the previous town council to regulate the burning of waste in Coeymans. Passage of the law was opposed by the international building materials conglomerate LafargeHolcim, which has a Title V permit issued in 2006, to burn tires to generate tire-derived fuel. Because of a recent Maryland court decision striking down the city of Baltimore's Clean Air Law, the company is now threatening to take legal action if changes are not made to the Coeymans law, Town Supervisor George McHugh said at a public meeting on October 22. A committee charged with reviewing the existing law submitted a 71-page report in August. McHugh says the law is currently unenforceable, both legally and practically. The public hearing on the amendment will be held at 6 p.m., Thu., Nov. 19, in town hall. The board is expected to take action sometime after the public meeting.
