New York appeals after judge rules against mask mandate
Nick Reisman reports at New York State of Politics that the indoor mask mandate in New York schools remains in effect as New York appeals a state Supreme Court ruling issued Jan. 24 striking down a Health Department rule requiring masks in all indoor public places, including schools. "It is SED’s understanding that the Department of Health will appeal the Nassau County Supreme Court decision, which will result in an automatic stay that will unambiguously restore the mask rule until such time as an appellate court issues a further ruling," a letter from the state Education Department read. "Therefore, schools must continue to follow the mask rule.” A New York Supreme Court judge in Nassau County on Jan. 24 ruled against New York's indoor mask mandate, that is set to expire on Feb. 1. State Attorney General Letitia James' office filed a notice to appeal Jan. 25. The judge ruled that a mask mandate was legal if passed by the legislature, but not if it came from the Department of Health and the governor's office.
