Abelove again tries an appeal

Kenneth C. Crowe II reports in the Times Union that the Appellate Division of state Supreme Court ruled unanimously in November to reinstate charges against former Rensselaer County District Attorney Joel Abelove. Now Abelove is asking the Court of Appeals for permission to appeal that ruling. If Abelove is not allowed an appeal, then state Supreme Court Justice Jonathan D. Nichols of Columbia County will start his trial Aug. 3 over his handling of a police shooting. In November the appeals court ruled Nichols was incorrect in 2018 when saying that former state Attorney General Eric Schneiderman's office lacked the authority to prosecute Abelove for perjury and "erred in granting defendant's motion to dismiss the indictment." Abelove is charged with one count of first-degree perjury, and two counts of official misconduct, a misdemeanor. The case is based on a police shooting of unarmed drunken driving suspect Edson Thevenin in Troy. Abelove put the case before a Rensselaer County grand jury just five days after the shooting.
