Without proof of cleanup Cascino sent back to jail

Diane Walden is reporting in The Columbia Paper it has been 440 consecutive days, and Salvatore Cascino [kah-SHEE-no] remains in Columbia County Jail. And the 77-year-old Larchmont resident will stay locked up until he presents "clear and convincing proof" that he obeyed the court's order to remove more than 9,600 cubic yards of illegally dumped solid waste from his Copake property. In an appearance during the ongoing contempt proceedings before Judge Jonathan Nichols on Wed., Nov. 8, Cascino's attorney, Greg Lubow, said Cascino's employees have removed a total of nearly 10,000 cubic yards of material from the 300-acre property located on the east side of Route 22, since August. However, Nichols told Lubow his client has to provide proof that whatever was removed was the offending material and that it had been deposited at a facility licensed to accept such contaminated material. "You have presented no evidence that it has been removed,” Nichols said. He then scheduled the matter for review again on January 10, and ordered Cascino back to jail. Cascino has battled local officials for nearly two decades, over violations of federal, state, and town laws for illegal dumping, building and excavating. Read the full story in The Columbia Paper.
