Groups file suit over Coeymans rezoning

Bryan Rowzee in the Ravena News-Herald reports that Hudson River Sloop Clearwater, Coeymans Heritage Society, and other parties have filed an Article 78 legal challenge against the Town of Coeymans, about 309 acres near Route 144 bordering Coeymans Creek recently rezoned to industrial use. In March, New York State Supreme Court Judge Michael C. Lynch nullified a more geographically far-reaching zoning change, the groups notes. This matter concerns the Coeymans town board vote of 4-1 May 12 to rezone the nine contiguous tax parcels to industrial use. Town Councilman Thomas Dolan, the lone neigh vote, then predicted a future legal challenge. “We didn't debate the EAF (Environmental Assessment Form). I believe that the board erred in not fully discussing each question. I think it is proper for us to take into consideration possible uses of the properties involved so that we don't end up in a court of law, losing again. I think we are in legal jeopardy by glossing over part two of the (long EAF) form." "I respectfully disagree," said Town Supervisor Stephen Flach at the same meeting.
