Col. County DA drops first SAFE Act charge

May 24, 2013 6:49 am
Gail Heinsohn reports in the Register Star Columbia County District Attorney Paul Czajka (CHAI-kah) has declined to prosecute the first alleged SAFE Act violation in the county. In an appearance in New Lebanon Town Court Thurs., May 23, Czajka dropped the charges lodged against Hopewell Junction resident Gregory Dean Jr., by the New York State Police in May. Dean was charged after he was allegedly found in possession of a loaded magazine containing nice rounds of ammunition, an amount in excess of the seven rounds permitted by the new law. In court Thursday, Czajka said he would “decline to prosecute the unlawful possession of ammunition feed devices.” A number of factors relate to any decision a prosecutor makes, he said, but "given the circumstances of this case, it was my decision to exercise my prosecutorial privilege."
