Cuomo to sign Lavern's Law to aid medical malpractice victims

Erin Durkin is reporting for the Daily News Gov. Andrew M. Cuomo is expected to sign into law the medical malpractice bill known as Lavern’s Law this week, after the state Legislature votes to amend the version of the measure it passed in June. The new law would increase the window of time to bring a claim of medical malpractice against a physician who improperly diagnoses cancer from 15 months to two and a half years from the time the patient discovers the error. Currently, the clock starts running when the mistake occurs and patients have only 15 months to take action. The law would make it clear the new rules apply only to cancer, not other illnesses. The legislation is named for Lavern Wilkinson, of Brooklyn, who died in 2013 of a curable form of lung cancer after doctors at Kings County Hospital misdiagnosed her.
