Corruption witness in Cuomo aide trial violates agreement, is arrested

Victoria Bekiempis reports in The New York Daily News that a day after a witness in the corruption trial of former Gov. Cuomo aide Joseph Percoco admitted that he attempted to defraud a hotel about a month after he signed that agreement with prosecutors, he was arrested Feb. 9. Todd Howe, a former lobbyist, admitted to acting as the middleman in an alleged bribery scheme. He had agreed to testify against Percoco as part of a plea deal. But part of that plea deal included Howe agreeing not to commit any more crimes. In his Feb. 8 testimony he admitted breaking that promise. Howe was asked whether he called his credit card company and lied about a hotel stay to remove charges from his credit card. “I don’t recall, but I’m sure if you said I did, I did,” Howe said. “You called your credit card company and lied about staying at the Waldorf the very night you were seeing the government?” the prosecutor later pressed. "Correct," Howe replied, then admitting he violated his plea agreement. Cuomo has refused to answer any questions about Percoco or the trial while it continues.
