Appellate court tells DA he cannot prosecute case

Bob Gardinier reports in the Times Union a state appellate court unanimously rejected Columbia County District Attorney Paul Czajka's (pronounced CHAI-kah) appeal of a ruling that blocked him from prosecuting a case he formerly presided over as a judge. The Appellate Division of the state Supreme Court declined on Thurs., Nov. 8,  to reverse a lower court ruling that forbids Czajka's office from prosecuting the case of Nicholas Fox, who faces a weapons possession charge. That ruling ordered Czajka's recusal and appointed the office of Greene County District Attorney Terry Wilhelm as a special prosecutor. Czajka was a county judge for 16 years before winning election as district attorney last year. He presided over Fox's arraignments in 2010. Read the full story in the Times Union.
