Rensselaer County DA Abelove indicted

Matthew Hamilton reports in Capitol Confidential that Rensselaer County District Attorney Joel Abelove was indicted on felony perjury and two counts of official misconduct Dec. 1 for his handling of a, April 2016 fatal police-involved shooting in Troy. “As we allege, District Attorney Abelove’s actions violated the law and undermined a criminal investigation,” state Attorney General Eric Schneiderman said in a statement. “The Governor’s Executive Order was designed to restore public confidence in our criminal justice system – yet the actions we detail today only served to further erode that confidence. My office will continue to work collaboratively with law enforcement agencies across the state, including district attorneys, to ensure fair, comprehensive, and independent investigations of every case within our jurisdiction, so that families like the Thevenins get the answers they deserve.” Abelove was arraigned before Columbia County Court Judge Jonathan D. Nichols. Abelove previously challenged Gov. Andrew Cuomo’s 2015 executive order that let the state attorney general’s office investigate cases where unarmed civilians are killed by police. A judge turned down Abelove's challenge to Cuomo's order. Abelove's office investigated the shooting by Sgt. Randall French, but cleared the officer, though was criticized for how quick that investigation was, and what evidence it overlooked. Read the full story in Capitol Confidential.
