Rensselaer County Clerk files suit against state license law

Nick Reisman reports for New York State of Politics that after weeks of promises, Rensselaer County Clerk Frank Merola filed a federal lawsuit July 24 attempting to overturn a new state law that would allow undocumented immigrants to apply for driver’s licenses. Erie County Clerk Mickey Kearns, a Democrat, beat Merola with a similar legal challenge filed earlier this month. “The governor, senators and Assembly members have not listened to the people of this state but will now be required to listen to the courts,” said Merola, a Republican. In Columbia County Clerk Holly Tanner hasn't said exactly what she will do when a new law takes effect allowing driver's licenses to be issued to undocumented immigrants. “While not in favor of how this bill was written due to myriad issues, I am waiting to see the outcome of potential lawsuits and determination from the NYS DMV leadership on how this law, if it stands, will be implemented in regards to points, documentation, verification, etc.,” Tanner, a Republican, said in an email to the local newspaper.
