Albany DA will no longer prosecute low-level marijuana cases

Robert Gavin is reporting for the Times Union Albany County District Attorney David Soares announced November 15, he will no longer prosecute the two lowest level of marijuana possession cases. Soares will also ask the courts to seal records for anyone previously convicted of those charges. The policy change would impact anyone charged with possessing up to two ounces of marijuana, a B-level misdemeanor, or the unlawful possession of marijuana, a violation similar to a traffic ticket. Anyone accused of selling marijuana, or of carrying greater quantities of pot can still face prosecution on misdemeanor or felony possession charges. Those charged with trafficking will continue to face prosecution, as well. New York has decriminalized minor marijuana possession and legalized medical marijuana. The state may legalize recreational use when the legislature convenes next year. Earlier this year, Manhattan District Attorney Cy Vance announced marijuana possession cases would no longer be prosecuted unless the drug was being actively sold or a threat to public safety.
