Stamford wants transmitter tower rent

A staff report in the Mountain Eagle says Stamford Village is suing Delaware County and the state of New York for, "non-payment and breach of contract for the use of a radio tower located on Mount Utsayantha." Emergency communications are beamed from the tower, but monthly rent has not been paid since 2005, and the town has sent letters demanding the $6,620 balance. “Dismantling the transmitter may pose a threat to public safety,” said town attorney Thomas Gallagher at a recent Stamford meeting. “It is my understanding that Delaware County and the towns of Stamford, Roxbury, Harpersfield, Kortright and Davenport use that transmitter in emergency situations. Many citizens and municipalities depend on the transmitter.” Town board members unanimously voted to authorize Gallagher to file an eviction notice against the county and state, to commence legal action against the county and the state for payment due, and to investigate what options the village has for the eventual removal of the tower for breach of contract.
