UPDATED: Court of Appeals rejects Amedore appeal

Jimmy Vielkind reports at Capitol Confidential the state Court of Appeals ruled Wed., Jan. 16, it will not hear arguments in the 46th Senate District race. This now clears the way for 99 additional ballots to be counted as soon as this week. The state's highest court said it will let stand a mid-level court's decision to open the ballots in the race between Republican George Amedore and Democrat Cecilia Tkaczyk (KAT-chik). Amedore currently holds a 37-vote lead over Tkaczyk. He was formally certified the winner of the race last month. The ballots are expected to be opened Thursday and Friday. Also Wednesday, it was revealed an additional absentee ballot cast by a Democratic election inspector in Montgomery County was located in the bottom of a ballot bag, Mon., Jan. 14. UPDATE (12:45 p.m.) Vielkind is now reporting Amedore’s lead has shrunk, slightly, after eight more ballots were opened in Greene County this morning. That process netted three votes for Amedore and five votes for Tkaczyk. The remaining 91 votes will be examined Fri., Jan. 18. One ballot is located in Albany County, while 90 ballots will be examined by Ulster County election officials in Kingston.
