Cuomo, other govs, sue feds over taxes

Rick Carlin reports at Capitol Confidential that Gov. Andrew Cuomo announced a federal lawsuit against the recently passed Republican tax plan, saying it unfairly targets high-tax Democratic states. The governors of New Jersey and Connecticut joined in the lawsuit. They hope to find nefarious political emails during the discovery part of the trial. “All you need is an email saying that these are Democratic states and we can get it passed. Now you have a targeting for political reasons and now you are off to the races," said Cuomo. While Republicans are used to be associated with state's rights, these Democrats plan to use that argument to contend that the limit on state and local deductibility of taxes (SALT) violates the states’ rights doctrine as well as the equal protection clause of the U.S. Constitution. “This violates both principles,” said Cuomo, who added, “We believe there is a very strong argument that it is unconstitutional.” Read the full story at Capitol Confidential.
