Rhinebeck town officials make deal with Red Wing
William J. Kemble is reporting in the Daily Freeman Rhinebeck town officials have reached an agreement with Red Wing Sand and Gravel. That agreement requires the mining company go through a local appeal process before filing any legal challenges to recently adopted zoning amendments. “It sort of suspends the time period by which they can file a suit under (state) Article 78 in order to encourage them to go through the administrative process,” town Supervisor Elizabeth Spinzia said. The Town Board in September voted to adopt a revised zoning map that officials said reflects comprehensive plan language about limiting mining to approved locations. Town Board members began working on the zoning amendments in 2011 after learning that language in the town’s 2009 comprehensive plan called for limiting mining to current operations, but a map produced by Dutchess County showed mining would be allowed on entire parcels.
