NYS appellate panel suspends Rudy Giuliani from the practice of law
Jane Wester is reporting for the New York Law Journal Rudy Giuliani has been suspended from the practice of law in the state of New York, according to a decision published June 24, by the First Judicial Department. “We conclude that there is uncontroverted evidence that [Giuliani] communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020,” the appellate panel wrote. The suspension is effective immediately and will continue until the disciplinary matters pending before the attorney grievance committee have been concluded. According to the First Department’s unanimous decision, the interim suspension applied to Giuliani is a rare and serious step. The basis for taking the action was the uncontroverted claims of professional misconduct, and the court also found there was evidence of continuing misconduct. Giuliani’s attorneys argued the investigation into their client's conduct violated his First Amendment right of free speech. The panel noted that courts have long held that speech by attorneys is subject to more regulations than speech by ordinary people. State Sen. Brad Hoylman, an attorney and chairman of the judiciary committee, filed a complaint in January against Giuliani, citing his “role in fomenting a violent insurrectionist attack” on the U.S. Capitol on Jan. 6.
