Judge upholds Stephentown ZBA ruling

Doug La Rocque reports in the Eastwick Press that New York State Supreme Court Justice Patrick McGrath dismissed Tom Hanson's lawsuit asking that Stephentown Zoning Board of Appeals member Dave Cass’s vote to grant Brian Baker’s appeal of the town’s permitting of the trailer park be denied. Several, but not a majority of town officials remember that Cass’s appointment to the ZBA on January 1 was contingent that he recuse himself on Baker’s appeal because he was not part of the Board when the process was started. In his ruling McGrath agreed that the Cass appointment came without any conditions or contingencies, which meant that the trailer park vote is allowed to stand. He also ruled that the Rensselaer County town's Zoning Board did not violate the Open Meetings Law by going into executive session, and ruled against the lawsuit's request to depose Town Board member P.J. Roder and Town Clerk Stephanie Wagar. Read the full story in the Eastwick Press.
