Court rules in Ginsberg's Article 78 appeals

Siobhan (SHIV-on) Barton is reporting in the Register Star Columbia County Judge Richard Koweek Tue., May 26, dismissed four Article 78 appeals related to the rejected plans to build a new Ginsberg’s Foods facility on the Ghent/Claverack border. Koweek found the Ghent Planning Board contradicted itself when it denied in December the food service distributor's plans to construct a new 295,000-square-foot facility. The refusal to approve the project was determined to be arbitrary and capricious, and not based on substantial evidence, according to Ginsberg's attorney Charles Malcomb. Koweek ordered the town of Ghent to issue an approval of the special use permit application. "We are pleased with the decision and look forward to working with the towns to grow our business,” said John F. Brusie, Ginsberg’s vice president of operations.
