Trump lawyers try to dismiss rape suit

Jan 06, 2020 12:42 am
Tal Axelrod reports in The Hill that on Jan. 3 lawyers for President Trump asked a New York judge to dismiss a case brought by a woman who claims he raped her in a department store dressing room 20 years ago. Trump's lawyers mainly argued on jurisdiction, saying E. Jean Carroll, an advice columnist, can't sue the president in New York. Lawyers for the president noted that he hadn’t been served the complaint in New York, but that's because Secret Service agents blocked attempts to serve the complaint. A judge ruled Carroll could mail the suit to the White House. “When E. Jean’s case was filed, Donald Trump maintained a home in New York, was registered to vote in New York, paid taxes in New York, and had been sued in New York on numerous occasions -- including since 2016 -- without any objection,” Roberta Kaplan, Carroll’s lawyer, told Bloomberg News. “Tellingly, as his papers make clear, what this motion is really about is a transparent effort to avoid discovery at all costs in a case involving a sexual assault.” Carroll is one of at least two dozen women who have accused Trump of some sort of sexual misconduct, though the president denies all allegations made against him.
