Judge tosses haul road lawsuit

Amanda Purcell is reporting for Columbia-Greene Media the lawsuit filed by the city of Hudson against the Greenport Town Planning Board over the environmental review of the A. Colarusso & Son Inc. haul road project has been dismissed by the state Supreme Court. In a decision and order dated Jan. 2, Acting Supreme Court Justice Michael Melkonian found the city Planning Board's negative declaration "was not affected by an error of law, arbitrary and capricious, or an abuse of discretion," as was alleged. The court further concluded that Greenport’s determination on the project was properly issued. “The extensive record herein reflects that the Planning Board conducted a thorough analysis of the potential environmental impacts that were identified during the initial meeting in May 2016 and throughout the comment period,” Melkonian wrote. The court also noted there were 16 meetings, including a special public information meeting, multiple consultations with state agencies, regarding wetlands, plants, wildlife, and dust; consultation with an expert on the wildlife issues; consultation with the state Department of Transportation; “care, consideration and response to the more than 400 comments raised during the comment period;” and a review of all written documentation filed with the Greenport Planning Board and the Columbia County Planning Board.
