TCI of New York sues Ghent Planning Board, ZEO

John Mason reports in the Register Star Columbia County Court Judge Jonathan Nichols has issued a temporary restraining order to the Ghent Town Planning Board and Zoning Enforcement Officer Gilbert Raab, in response to a legal action filed by TCI of New York, LLC. The transformer dismantling and transporting company is seeking to prevent Raab from following the Planning Board’s directive to reconsider his earlier finding on which permits the company requires. TCI's 30,000-square-foot facility on Falls Industrial Road burned to the ground, Aug. 1. It is now seeking permission to rebuild that facility. The suit argues the Planning Board exceeded its authority when it asked Raab to reconsider his determination about what town code requirements were applicable to TCI's request to rebuild.
