Cairo contemplates doubling down on state law

Andrea Macko reports in Porcupine Soup that a Cairo town board member wants to pass a new local law banning anyone cutting their lawn from spraying their grass clippings on a roadway. “This is someone’s life you are taking into your hands… it’s like running into an oil slick or ice,” said Powers. “People are going to go down, people are going to get hurt, and people are going to get killed.” If Powers is correct, then state law already bans spraying grass clippings on a roadway. Section 1219 of the New York State Vehicle & Traffic Law states: “No person shall throw or deposit upon any highway any glass bottle, glass, nails, tacks, wire, cans, snow or any other substance likely to injure any person, animal, or vehicle upon such highway.” Also, Section 1220 provides that “no person shall throw, dump, deposit or place, or cause to be thrown, dumped, deposited or placed upon any highway, or within the limits of the right of way of such highway, or upon private lands adjacent thereto, any refuse, trash, garbage, rubbish, litter or any nauseous or offensive matter.” Town Attorney Tal Rappleyea is drafting a bill with the first offense punishable by a $350 fine and a $750 fine for the second violation. Powers wants a a public hearing on the law in August. and to pass the measure in September in time for the Catskill Mountain Thunder Motorcycle Festival at Blackthorne Resort in neighboring East Durham. “There are going to be a lot of bikes on the road,” he said.
