Court: Rhinebeck can issue solar permits

Kemble reports in The Daily Freeman Rhinebeck can continue issuing permits for solar energy installations, a four-judge panel of the Appellate Division of state Supreme Court ruled May 3. “The temporary injunction sought against the town ... was denied ... which means while the appeal is pending, if there is one, we are free to issue permits for solar farms,” said town of Rhinebeck Supervisor Elizabeth Spinzia. Three neighbors – Amanda Miller, Eric Wallach and Philip Coratti – filed the suit. They live next to the Sherrod property on Wurtemburg Road, where a solar farm is proposed. Their suit claimed that some members of an advisory group did not disclose conflicts of interest while the solar regulations were being drafted. But the court disagreed. “The task force was simply a volunteer group the Town Board convened to aid in the development of a proposed local law,” the court's decision said.
