Tkaczyk files appeal over contested ballots

Jimmy Vielkind is reporting in the Times Union Democrat Cecilia Tkaczyk (KAT-chik) has filed an appeal from a Montgomery County judge's decision to invalidate 333 absentee and affidavit ballots in the 46th state Senate race against Republican George Amedore. Tkaczyk contends in court papers filed Wed., Dec. 26, a series of hyper-technical mistakes by voters led to the invalidation of hundreds of ballots. Amedore was certified as the winner of the race by acting Supreme Court Justice Guy Tomlinson last week. Amedore's campaign will file a formal reply to the appeal by Fri., Dec. 28. The case will be argued in Albany, Jan. 7, two days before the state Senate is scheduled for formally convene. The outcome of the race could effect which party controls the Senate.
