Matthew Hamilton is reporting at Capitol Confidential a new poll has Republican John Faso leading Democrat Zephyr Teachout by six points in the 19th Congressional District race, in the final days before the general election, Tue., Nov. 8. Faso is ahead 48 percent to 42 percent, according to a Time Warner Cable News/Siena College poll of likely district voters released early Sun., Nov. 6. Faso’s overall position is strengthened by a sudden 13-point lead among independent voters in the district. The 19th Congressional District is evenly divided into three parts, among Democrats, Republicans and unaffiliated voters. Faso continues to perform well in his home portion of the vast district. The Kinderhook Republican leads Teachout in Montgomery, Schoharie, Greene, Columbia and Rensselaer counties by 23 points. In the past weeks, Teachout's lead in Dutchess and Ulster counties, her home base, has decreased to three points. To be competitive, Hamilton reports, Teachout must have a strong showing in heavily Democratic Ulster County on Election Day. Ulster has the largest Democratic enrollment advantage of anywhere in the 11-county district, but Ulster is the only county in the district where the number of independent voters outweighs the number of voters enrolled in one of the major parties. Lorna Cherot Littleway is reporting in The Columbia Paper the results of state mandated water testing for lead contamination in the Taconic Hills School District are in. At the Board of Education meeting last month, Facilities Director Nicholas Smith updated the board, reporting that out of 400 water samples, 80 faucets were deemed to have unacceptable levels of lead. More than half of the contaminated sources were from faucets in labs and outdoor hoses, not the usual source for drinking water. Thirteen bathroom sink faucets and eight other classroom style faucets also have lead levels considered too high. The district must now develop a remediation plan. Smith said that three kitchen sink faucets have been replaced and will be re-tested. Those locations are commonly used for food preparation and hand washing. Also, “Not Potable Water” signs have been placed in labs and near the suspect hoses. Read the full story in The Columbia Paper.

Broadcasting and Cable reports that the Prometheus Radio Project is challenging parts of the FCC's Aug. 25 quadrennial ownership review, and the legal battle between the non-profit group and the radio regulators continues now for more than a decade in front of the U.S. Court of Appeals for the Third Circuit. Prometheus and the Media Mobilizing Project said in their filing that the FCC again failed to satisfy directives from the court by reinstating an earlier definition of eligible entity the court had vacated and remanded, "while citing no additional evidence to show that this definition will promote ownership opportunities [for] minorities and women." Prometheus is challenging the FCC on several issues, including the decision to modify some broadcast ownership rules, "so as to permit increased concentration," as well as its "failure" to treat shared services agreements as attributable ownership interests subject to local market duopoly rules. "While we generally support the decision to retain the ownership rules and reinstate JSA [joint sales agreement] attribution, the Commission's intransigence with respect to getting reliable data to make meaningful efforts to diversify ownership is a serious legal and policy error," said Andrew Schwartzman, one of the attorneys for Prometheus, a Philadelphia-based non-profit group that sprung out of a pirate radio station there.
